살인의 영향과 피해자 지원에 관한 소고

국문 초록

본 논문은 살인의 피해자들이 형사사법시스템에 참여하는 과정, 살인이후 일어나는 심리적 외상과 감정적 측면에서 그들이 원하는 것이 무엇인지에 대해 살펴보았다. 먼저 살인이후의 일반적인 심리적 변화 과정은 비통의 단계 모델을 대체로 따르지만 기간ㆍ강도ㆍ복잡성에 따라 개인차가 나타난다. 살인으로 가까운 사람을 잃은 사람들은 보통 PTSD로 발전할 가능성이 매우 높다. 형사사법기관의 담당자들이 하는 행동과 대처방식에 따라 피해자들의 심리적 회복과정에 영향을 미치며, 상담기술ㆍ대처방안 등의 교육을 통하여 피해자들의 피해회복에 큰 도움이 될 수 있다. 피해자들은 형사사법절차를 비롯한 피해회복의 전 과정에 걸쳐 접해야 하는 기관들과 모두 연계될 수 있는 법적조직을 필요로 했으며, 양육비, 정신과 상담, 법적 비용 등 피해자에 대한 배상분야가 다양화 될 필요가 있다. 선행연구들의 결과와 마찬가지로 많은 피해자들은 형사사법기관으로부터의 정보를 구하는데 있어 심각한 좌절감을 느끼고 있었는데, 수사과정 및 사법절차에 관한 정보가 시의적절하고 정확하게 전달되어야 할 것이며, 이는 피해자를 존중하고 배려하는 태도로 이루어져야 할 것이다. 이를 위해서 단일화된 지원 시스템이 신속하고 적절한 의사소통에 효과적일 것이다.

영문 초록

This article outlines some of the emotional and practical aspects of traumatic bereavement and the needs that subsequently arise, with particular regard to bereaved people's involvement with the criminal justice system. The emotional and psychological process follow the stages of grief. It differ significantly in duration, intensity and complexity. People bereaved by homicide are at significant risk of developing post-traumatic stress disorder(PTSD). Bereaved people would be helped greatly if staff within criminal justice agencies who deal directly with families of murder victims were given training in counselling skills, trauma and grief, and were made aware of how their actions and behavior can help and hinder the grief process. Practical and domestic issues was important problem with victims. Anxiety about being able to manage financially affects many bereaved people, particularly when the victim was the main wage earner. Problems associated with child-care were mentioned by many victims, most notably by grandparents who found themselves with unanticipants new responsibility for children whose mothers had been killed by their fathers. The paucity of support for children bereaved by homicide should be considered. There needs to be statutory body to take on overall liaison with all the agencies. It is necessary for victims to vary victim compensation program including child-care costs, counselling and legal fees. In view of the frustration that many bereaved people experience at getting information from criminal justice agencies, it is important that the criminal justice system service prioritizes conveying timely and accurate information to bereaved relatives in a sensitive and respectful manner. So building a one-stop support system is useful for sensitive and rapid communication.
