국문 초록

본 논문의 목적은 스토커의 스토킹 행위 이전에 그들의 행동을 예측하여 심각한 범죄로 나아가는 것을 예방하고, 일반범죄자와 스토커를 구별하여 스토커에 맞는 형사정책적 방안을 강구하기 위해 스토커의 심리적 특징을 이해하는데 그 목적이 있다. 이에 본 논문에서는 앞으로 보다 중요한 연구주제가 될 것으로 예상되는 스토커의 심리적 특성에 관한 국내외의 선행연구의 검토 및 사용가능한 측정도구에 대하여 사전적이고 탐색적인 연구를 진행하였다. 스토커의 정신의학적 위치를 미국정신의학회의 진단편람을 통해 살펴보면 축Ⅰ의 심리장애 유형 중 약물관련 장애, 기분장애, 정신병적 장애, 적응장애, 망상장애 영역에 자리하고 있었다. 그리고 3가지 인격장애 중에서는 극적이고 감정적인 특징을 가지는 B군 성격장애에 위치하고 있음을 알 수 있었다. 스토커의 심리적 특성은 크게 스토커와 피해자와의 상호관계를 바탕으로 한 스토커의 동기성에 따른 것과 정신 병리적 특성으로 나누어 검토했다. 동기에 따른 스토커의 심리적 특성은 단순망상, 애정망상, 성적망상, 왜곡된 피해자망상 등이 있었고, 정신병리적 특성으로는 연애망상, 관계망상, 환각 등 정신병적 특성과 과대망상적 특성, 경계 인격장애적 특성, 자기애성 특성, 그리고 반사회성 인격장애적 특성 등이 있었다.

영문 초록

The purpose of this study is to predict stalkers’ behavior prior to the criminal reaching a level of serious stalking activity. By better understanding the psychological characteristics of stalkers, law enforcement agencies will be able to provide proper criminal justice system that will allow agents to distinguish between general criminals and stalkers. This paper will identify such psychological characteristics of stalkers allowing for the development of measurement scales which will decrease the risk of criminal behavior reaching a serious stalking level. According to the APA’s stalker’s psychological characteristics’ measurement of scale, medical related disorder, emotional disorder, psychological disorder, adaptation disorder, delusion disorder categorized psychological disorder pattern I. Three different personality disorders revealed emotional feature related with characteristics disorder type B. Stalker characteristics have two major features which include motivation from the interrelationship between the stalker and victim and psychological pathology of the stalker. The first features include delusional characteristics such as general delusion, sexual delusion, and misunderstood victim delusion. The second feature, the psychological pathology feature, includes characteristics such as date delusion, relation delusion and includes hallucinosis in which case the stalker is prone to cases of hallucination. Additionally the psychological pathology feature includes psychological disease characteristics including expansive delusion, caution personal disorder and anti-social behaviors.
