교육에서의 장애 차별에 관한 국가인권위원회 결정의 의의와 한계

국문 초록

본 연구의 목적은 교육에서의 장애 차별에 관한 국가인권위원회 결정의 의의와 한계를 분석하는 것이다. 그 주요 결과는 다음과 같다. 첫째, 국가인권위원회는 장애의 개념을 제시하지 아니하였다. 둘째, 국가인권위원회의 결정에는 장애인에 관한 3가지 관점이 공존하였다. 국가인권위원회는 장애를 약점으로 간주함으로서 장애인에 대한 낙인 효과를 유발할 위험성이 있고, 정당한 편의 제공을 충족시키기 위하여 장애인이 어느 정도로 사회에 참여해야만 하는지를 명료화하는 데에 실패하였다. 셋째, 국가인권위원회는 국가인권위원회법 제2조 제4항에 규정된 차별의 개념을 차용하거나 구체적인 사례를 제시하였다. 이는 장애 차별의 법률적 정의를 반영하고, 최소한 장애 차별을 감소시키며, 장애인교육의 중요성을 강조하는 의의가 있다. 반면에 국가인권위원회는 용어상의 혼란을 초래하였고, 적절한 교육과 동등한 교육 사이의 상충가능성을 간과하였으며, 적절한 교육의 개념과 판단기준을 명료화하지 못하였고, 통합교육의 범위를 축소한 한계도 있다. 끝으로, 국가인권위원회는 장애 차별의 판단기준으로 주로 합리적인 이유나 과도한 부담이나 현저히 곤란한 사정 등이 있는 경우를 사용하였다. 합리적인 이유의 의미를 해석하기 위하여 국가인권위원회는 진정직업자격요건, 과도한 부담이나 현저히 곤란한 사정 등이 있는 경우, 수평적⋅수직적 평등 개념, 그리고 평가 기준의 공정성이라는 기준을 사용하였다. 과도한 부담이나 현저히 곤란한 사정 등이 있는 경우를 결정하기 위하여 국가인권위원회는 구체적이고 개별적인 상황에서 개별적인 평가에 근거하여 판단하여야 함을 강조하였다. 이는 장애인의 관점을 고려하고, 학부모의 학교선택권을 강조하는 의의를 지니고 있다. 반면에 국가인권위원회는 자신의 결정이 비장애인에게 미칠 영향을 충분히 고려하지 못하였고, 장애인에 대한 어떤 편견이 금지되는지 모호하게 하였으며, 장애의 유형 및 정도에 대한 고려가 부족하였다.

영문 초록

The main purpose of the study is to analyze the strengths and weaknesses of the National Human Rights Commission of the Republic of Korea's decisions on discrimination on the basis of disability in education. The major findings are as follows. First, the Commission did not suggest the definitions of disability. Second, three perspectives regarding the disabled were coexisted in the Commission's decisions. They could cause the labelling effect on the disabled and failed to clarify how much participation in society is necessary to meet reasonable accommodation. Third, The Commission applied the definition of discrimination stipulated Article 2 Section of the National Human Rights Commission of the Republic of Korea Act to discrimination against the disabled on the basis of disability in education and suggested the specific cases on discrimination on the basis of disability in education. They could reflect the legal definitions of discrimination on the basis of disability, could contribute to at least reduce such discrimination, and emphasize the importance of education for the disabled. However, the Commission could cause confusion which terminology should be used, showed the conflicting view regarding equal and appropriate education, failed to clarify the definitions of and the standards for appropriate education for the disabled and narrowed the scope of inclusive education. Last, the Commission judged discrimination on the basis of disability in education on the basis of rational reasons and undue hardship. To interpret rational reasons, the Commission considered the bona fide occupational qualifications, undue hardship, the horizontal and vertical concept of equity, and the fairness of the criterion for evaluation. To decide undue hardship, the Commission argued for the necessity for the individualized evaluation in the specific and individualized situation. They considered the viewpoint of the disabled and implied the parental choice of the school. However, the Commission failed to consider the effects of its decisions on the non-disabled sufficiently, made which prejudice against the disabled was prohibited ambiguous and were lacking in the consideration of the type and severity of disability.
