탈북자 문제의 주요 쟁점과 전망

국문 초록

  본 논문은 재외 탈북자 문제에 대한 총체적 이해를 목적으로 한다. 이를 위해 먼저 탈북자 발생의 배경과 현황을 살펴볼 것이다. 2000년을 전후로 탈북의 동기는 생존 전략에서 삶의 질의 변화를 지향하는 것으로 변화하였다. 재외 탈북자의 인권 문제는 여전히 심각한 상황이며, 국제 사회의 중요한 쟁점으로 부각되고 있다. 북한 당국은 탈북자 문제에 대해 공식 입장을 밝힌 바는 없지만 국제사회의 압력이나 국제인권법에 대해 심각하게 반발하고 있다. 그럼에도 불구하고 북한인권법 제정 이후 탈북자 문제가 북한 체제에 주는 부담은 더욱 커지고 있기에 해결을 위한 모색이 필요한 시점이다. 이러한 탈북자 문제와 관련하여 한국정부는 실질적인 대응 방안을 모색해야 한다. 무엇보다 탈북자들이 체류하고 있는 각국에 대해 탈북자의 기본권을 보호하고 난민협약을 준수하도록 요구해야 한다. 그리고 탈북자 발생의 주된 요인인 북한의 경제위기를 위한 방안을 모색해야 하며, 탈북자들이 자발적 귀한을 선택할 수 있는 조건들을 마련하기 위한 노력을 해야 할 것이다.

영문 초록

  This study examines current conditions of North Korean defectors in overseas countries. Since 2000, the motivation of defection significantly changed from simple survival to pursuing better qualities of life. However, human rights problems facing North Korean defectors still severe and getting more attention from international society. North Korean government has never announced official policies to North Korean defectors. However, it is quite clear that North Korea feels pressures from denouncement of international society. Especially, The North Korean Human Rights Act of 2006 gives serious problems to North Korean political system. To improve human rights conditions of North Korean defectors in overseas, South Korean government has to try to find practical solutions. First, South Korean government should officially request to host countries to protect fundamental rights of North Korean defectors. Human rights of defectors can not be improved with continuing so-called calm diplomacy. Second, the government also has to find a solution to North Koreaøs endemic economic crisis that causes defectors. Finally, in accordance with international society such as Amnesty International, we should find a way to return them to North Korea without punishment.
