영문 초록

  The acts of counterfeit and unfair competition generally cause a heavy or harmful incidence with the companies victims. For them, it is not a question only of the loss of the turnover or benefit and the reduction in the market shares, but also in a priceless shock carried to the brand image of their products and their distribution networks and customers. The protection of the mark in the commercial relations and economic is thus a concern for many legal systems.
  Because of various legal traditions, France and Korea, each country organizes its legal system in a different way. The national standards can vary and present more or less clear nuances of one country to the other. France and Korea adopted necessary measures so that the trade-mark law is respected and to condemn the illicit acts as regards mark. In France, after more than two centuries of legislative and legal activities, its trade-mark law became a more complete and dynamic system. In more coding of the protection of the rights of the intellectual property in France appears to us a useful and effective way. In order to arrive at coding, the Code of the French intellectual property could be used to us as model of reference.
