종교계 사학의 특수성 보장을 위한 발전방향 탐색 - 독일의 가톨릭계 학교를 중심으로

국문 초록

  서구 국가의 학교발달사를 살펴보면 종교단체에 의하여 설립된 사립학교들이 큰 역할을 해왔지만 공교육이 발달되면서 종교계 사립학교의 특수성과 자율성 보장을 둘러싸고 많은 논쟁들이 벌어졌다. 이러한 논쟁은 우리나라 역시 예외가 아닌데, 특히 고등학교 이하에 있어서는 고교평준화제도의 대상으로 종교계 사학이 포함됨에 따라, 학생선발, 교육과정 운영, 교원 임용 등에 있어 상당한 국가적 통제를 받고 있다. 종교계 사립대학들도 지나친 국가의 간섭으로 인하여 자율적 운영이 상당히 제한 받으면서 종단학교의 교육 문제가 화두로 떠오르고 있다.
  따라서 본 연구에서는 독일을 중심으로 가톨릭계 사립학교들의 근간을 유지하기 위한 가톨릭교회와 국가와의 관계를 살펴봄으로써 가톨릭계 사학이 자율성과 특수성을 확보할 수 있는 방안을 모색하고자 하였다. 이는 국가와 종교단체 간의 많은 갈등을 겪고 있는 우리나라에서 문제점을 해결할 수 있는 실마리를 제공할 수 있을 것이다.
  한편, 독일의 가톨릭 사학은 국가와의 관계에 있어서 자율성을 많이 확보하고 있다. 역사적으로 가톨릭교회는 교황청과 협조하여 자체 내의 교육적 이념과 법적 체제의 정비를 통해 국가와 협조하고 있다. 그 결과 가톨릭 학교는 독자적 이념을 학교교육을 통해 구현하는데 국가로부터 적극적인 지원을 받게 되었다. 최근 사회가 다원화됨에 따라 가톨릭 학교의 종교교육이 타종교들과의 위상문제로 도전을 받고 있지만, 정교분리의 원칙에 입각한 국가의 법적체계 속에서도 여전히 그 특수성을 보장받고 있다. 종교계 사학들이 학교교육의 일반적 기능과 그들의 고유한 교육목적에 따른 종교적 가치를 전파하기 위한 기능을 유지하는데 있어서 독일의 사례는 시사하는 바가 크다.

영문 초록

  In the history of schools in Western countries, despite significant roles of private schools founded by religious groups, there have been fierce controversies over special nature of religious private schools and the guarantee on their autonomy, with the development of public education. Korea is not an exception from such controversy. As religious private schools are categorized into the schools covered by the student allotment system based on the location of residence at the level of high schools or below. They are under considerable government control over their selection of students, operation of curriculum, and appointment of teachers. Due to excessive government intervention, religious private colleges have found it difficult to realize their autonomy fully.
  Historically, the church has worked together with the state, by reorganizing its educational philosophy and legal system in cooperation with the Vatican. As a result German parochial schools could receive positive support from the state in realizing their unique philosophy through school education. The special nature of German parochial schools has been still protected in the context of legal system of the government in accordance with the principle of the separation of church and state. The German case has a lot of implications for maintaining general roles of religious private schools and their role of spreading religious values in line with their unique goals of education.
  Therefore, this study was designed to explore how to guarantee autonomy and special nature of parochial schools, by examining the relationship between the Catholic Church and the state to maintain the foundation of parochial schools focusing on Germany’s case, which is thought to provide a clue to solve a problem for Korea in which the government is suffering from serious conflicts with religious groups.
