저작권 상담사례 연구 - 대한출판문화협회 저작권상담실 상담사례를 중심으로

국문 초록

  이 연구는 지난 15개월 동안 대한출판문화협회 저작권상담실을 통해 이루어진 상담사례를 분석함으로써 최근 발생하고 있는 저작권 분쟁의 유형과 양상을 정리하고, 저작권자 및 저작물 이용자들 사이에 제기되고 있는 저작권 관련 의문점은 무엇인지 파악함으로써 저작권 상담업무의 지향점과 개선방안을 제시하는 데 그 목적을 두고 진행되었다. 연구 결과 아직도 우리 사회 전반에 걸쳐 저작권 관련 법과 제도에 대한 이해도가 매우 낮다는 점을 확인했으며, 저작권에 관한 전반적인 이해보다는 자기가 알고 싶은 사실만 알면 된다는 식으로 상담에 임하는 사람들이 많았고, 어떻게 하면 법망을 피해서남의 저작물을 이용할 수 있는지 알고 싶어 하는 매우 이기적인 상담요청자들이 많았다는 점 등을 알 수 있었다.
  이 같은 문제점들을 개선하기 위해서는 먼저 문화산업계 전반에 걸친 전방위적인 교육과 홍보가 이루어져야 하며, 교육 프로그램의 개발과 운영을 위한 업계별 ‘저작권교육위원회’의 설립이 필요함을 강조하였다. 또, 업계별로 다양한 계약서 작성 매뉴얼을 만들어 배포하고, 개별 업체에서는 사안별로 보다 구체적인 계약서를 작성할 수 있도록 관련 실무자들을 훈련시킬 필요가 있으며, 나아가 각종 협회 등 단체 차원에서 계약서 작성실무를 지도하고 실습할 수 있는 교육 프로그램을 개발하는 방법도 강구해야 한다는 점도 강조하였다.
  결론적으로, 저작권 보호의 당위성에 대하여 초등학교는 물론 중고등학교에서부터 가르쳐야 하며, 대학 및 대학원에서도 지속적으로 정당하고 공정한 저작물 이용 방법에 대해 가르치는 프로그램이 빠른 시일 내에 도입되어야 한다는 점, 나아가 상담 및 교육전문인력의 양성을 위하여 정부 차원의 지원과 연구가 이루어져야 하며, 산학협력의 틀안에서 대학 및 대학원에 전공과정이 개설됨으로써 문화산업의 기본권인 저작권 및 이를 지탱해 줄 법과 제도에 대한 연구와 실무에의 적용이 원활하게 이루어질 수 있도록보다 풍요로운 저작권 환경을 구축하기 위한 방안이 다각도로 검토되어야 한다는 점을 확인하였다.

영문 초록

  By analyzing the actual cases of consultation conducted in copyright clinic of Korean Publishers Association(KPA) for the last 15 months, the purpose of this study was to sum up categories and aspects of recent copyright disputes, and find out copyright-related questions posed among copyright owners and users, so that it could suggest favorable directions and improvement ways of copyright consultation works. As a result, it was found that we still stay at very low level of understandings about copyright-related laws and systems throughout our society in Korea. It was also noted that many clients relied on consultation service just to know what they wanted rather than get a general understanding about copyright, and there were lots of very selfish clients who wanted to see how to make use of other’s copyrighted works beyond legal constraints.
  In discussions, this study emphasized that better improvement of these questions requires omnidirectional education and public relations throughout domestic cultural industry, and the establishment of industry-specific ‘copyright education committee’ for developing and running relevant educational programs. In addition, it is necessary to distribute a variety of industry-specific agreement preparation manuals and train relevant staffs in each company so that they can prepare written contract in further detail case by case. Furthermore, this study also emphasized the necessity of devising possible ways to develop education programs for instructions and practice of preparing written contract in the aspect of organization including various associations.
  Summing up, it was concluded that the necessity of protecting copyrights should be instructed in middle and high schools as well as elementary schools; a series of programs to instruct in how to use copyrighted works justly and fairly should be introduced as early as possible on ongoing basis in both universities and graduate schools; governmental supports and studies should be carried on to foster staffs specializing in consultation and education; and possible ways to build up more affluent copyright environment should be reconsidered from multilateral angles by means of opening up major courses in university and graduate school in the framework of industry-academy collaboration, so that the follow-up studies in copyright as basic right in cultural industry and corresponding laws and systems should be conducted without a hitch in parallel with the application of those studies in practices.
