미국의 법체계 분석을 통한 특수교육 동향과 시사점

국문 초록

  본 연구는 미국의 법원과 사법체계의 수준과 특징을 탐색ㆍ제시하였다. 즉, 미국의 법원은 연방, 주, 지방정부의 수준으로 구분하며, 연방수준의 법원은 헌법, 제정법, 규칙, 판례법, 그리고 주정부 수준에서는 주헌법, 주제정법, 규칙, 판례법 등을 중심으로  살펴보았다. 사법체계는 주와 연방정부 수준에서 운영되고 있다. 주의 사법체계는 제1심관할법원, 중간상소법원, 주대법원, 그리고 연방의 사법체계는 지방법원, 항소법원, 대법원을 중심으로 궁서되어 있다. 그리고 미국의 주요 판례를 통한 특수교육 동향을 살펴보았다. 궁극적으로 본 연구는 우리나라의 특수교육 및 교육정책과 관련된 교원과 전문가들에게 미국의 법원과 사법체계에 유용한 정보를 제공하게 될 것이다.

영문 초록

  This study deals mainly with the U.S. court system and the sources of law. The sources of law as related to education can be found on federal level. state level, and local level. The federal level explains focusing on constitution, statutes, regulations, and case law. State level explains focusing on state constitution, state statutes, regulations, and case law.
  The U.S. court system is a two-tiered system that operates the state and federal levels. This system has its basis in the federal and state constitutions. The state court system explains focusing on courts of original jurisdiction, intermediate appellate courts, and state supreme court. The federal court system explains focusing on district courts, courts of appeal, and supreme court.
  Eventually. the study will present special education and teacher with useful informations about the U.S. court system and the sources of law. Based upon the reviews of the U.S. special education legal system. some implications for the improvement of its Korean special education legal system were suggested.
