영문 초록

Commercialization of sports activity have brought about professionalization of sport. Sport was originally not so economic activity and sports organizations were nonprofit that did not professionalize drastically. However in many items of sport as baseball, football, golf, wrestling, cycle race, speedboat race and some single sport is done as an "occupation" and athletes are paid for their play. Besides, amateur players appear to play as a hobby or nonprofessional activity but they do as a job practically. That is, amateur athletes' play is done continually not sporadically. Furthermore, it is understood as livelihood. Then their play assumes 'continuance' and 'sustenance'. Also it is the occupation for constitution article 15. Accordingly, their activity is supposed to be protected as a right of occupation. As sport develops, its tendency as a job is increasing. Therefore, they say it is need to protect sports activity as right of occupation which has basic right. It has been helped from the development from doing sports to seeing sports.
