한국토지 지목제도 개선방안에 관한 연구 - 지목불부합 해소 및 지목세분화를 중심으로 -

국문 초록

지목은 전국토의 토지이용현황을 필지별로 파악할 수 있는 유일한 정보이나 현대사회는 토지이용이 복잡·다양하고 토지의 불법적인 형질변경 등에 따라 지목불부합이 발생하게 되어 지적사무의 공신력 실추는 물론 토지관리 및 보상과정에서 토지현황을 반복·조사하고 있다. 이에 본 연구에서는 지목불부합해소와 표준화된 지목세분화 방안을 제시하기 위하여 문헌 및 선행연구를 조사·분석하고, 모델지역을 선정하여 방문조사를 실시하였다. 우리나라 지목은 일제가 과세목적으로 제정한 이래 토지의 생산력에 따라 토지지목을 조정·세분화하고 공공지목은 명칭만 변경해왔으나 지적제도운영상의 문제, 불법적인 토지이용 및 개발, 자연현상, 지목설정원칙의 불명확, 분류기준의 불합리, 지상·지하시설물에 대한 지목의 누락 등이 문제점으로 나타났다. 또한, 모델지역을 선정하여 방문조사를 실시한 결과, 지목불부합 모델지역은 51.9%가 지목이 불일치하였으며, 세분화 지역 대지의 경우에 113필지 중 112필지가 8개 종류의 토지용도로 사용되고 있어 지목세분화의 필요성이 있는 것으로 분석되었다. 따라서 지목불부합을 해소하기 위하여 개별공시지가 조사과정에서 토지이용현황을 조사하고, 건축물준공처리과정 등에서 지목변경사항을 확인하는 것이 필요하다. 그리고 「지목세분화방안」은 토지의 지목을 산업별, 용도별로 구분하여 실제사용하고 있는 용도에 따라 필지별 사용자 중심으로 국토조사체계에 맞게 3단계(대, 중 소)로 각각 세분화해야 한다.

영문 초록

Land category is the only information that can be used for identifying the current state of a nation's land by parcel. However, in modem society, land is used for various and complicated purposes, and people alternate terrain future illegally that leading to discrepancy in land category. This undermines public trust in the government's land registering, and forces the government to survey the state of land use recurrently for land management and compensation purposes when they need the data. This study suggests measures to resolve the land category discrepancy problem and standardized land categories specification method. For this, extensive references and previous studies in related areas reviewed. The current land category system of Korea was originally established to impose taxes during the Japanese colonial period. The Korean government specified and adjusted the land categories in accordance with the land productivities. As the results, many problems such as the land category discrepancy, illegal land development and use, natural phenomenon, unclear standards for the classification of land category, irrational classification standards, and lack of standards for ground and underground facilities have been emerged. Actual visiting assessment of the selected land category discrepancy sample areas revealed that the land category discrepancy occurred at 51.9% of the area. In case of category specification sample site, 112 out of 113 parcels were used as 8 different purposes indicating the need of further specified land categories. This study suggests that the assessment of land use status, simutanous processing of the building completion inspection and land category alteration, assertation of land category alteration upon building registration and various approval and permission procedure should be required to measure the aforementioned problems. 「Land category specification measure」 should classify the land categories according to the industry types and land use purposes so as to specify three national land survey system scopes (large, medium, small) to indicate the actual users and purposes of the land.
