국문 초록

본 연구의 목적은 지적공부의 등록사항정정에 관한 실태를 조사·분석하고, 이를 토대로 지적공부 등록사항정정에 관련된 문제점을 도출함으로써 효율적인 지적공부의 등록사항정정에 대한 개선방향을 제시하는 것이다. 이상과 같은 연구목적을 효율적으로 달성하기 위하여 연구대상을 지적공부의 등록사항정정으로 한정하고, 연구범위를 시간적으로는 2002년 1월 l일부터 2004년 12월 31일까지로 하고, 공간적으로는 경상북도 영주시 지역으로 하며, 내용적으로는 지적공부의 등록사항정정에 관련된 문제점을 도출함으로써 효율적인 지적공부의 등록사항정정에 대한 개선방향을 제시하는 것으로 한정하였다. 본 연구에서 사용된 연구방법으로 접근방법은 행정적 접근방법을 사용하였고, 조사방법은 문헌조사법과 사례조사법을 병행하였으며, 분석방법은 記述的 分析法을 사용하였다. 연구 결과, 문제점으로는 첫째, 직권정정처리로 인한 경계분쟁의 발생 둘째, 현장조사시 단순한 지적측량의 실시 셋째, 정리대상 토지의 장기간 방치로 나타났다. 이러한 문제점을 해결하기 위한 개선방향으로 첫째, 소유자 신청에 의한 정정 둘째, 측량조사 방법의 다양화 셋째, 등록사항정정 처리절차 개선 넷째, 등록사항정정 대상 토지에 대한 현황표 작성 등의 개선이 필요한 것으로 제시하였다.

영문 초록

The purpose of this study is to investigate and analyze the actual condition of the correction of registered matters in the cadastral record book. Based on this, Several points were raised concerning the correction of registered matters in the cadastral and the improve measurement is presented as the effective correction of registered matters in the cadastral record book. For the accomplishment of the above objective, the study scopes were limited. the termtime was from January 1st, 2002 to December 31st, 2004, the area was in YoungJu, Kyung Sang Buk-Do, Korea, and the purview of the contents was determined on the effective correction of registered matters in the Cadastral record book. The approach used in this study was the applicated administrative method, The process of analysis used the descriptive method. As seen from the results of the study, There are a few problems which followed; First, Raising boundary dispute at the time it is treated in virtue of the office. Second, Simple examination of Cadastral survey. Third, Negligence of subjective land of readjustment. The improvements for the solution to the problems are proposed to be as follows; First, the correction as per the land owners I proposal. Second, diversifying examinations of cadastral survey. Third, improving regal formalities of the correction of registered matters. Fourth, drawing inspectable statement of the subjective land of readjustment for correction of registered matters.
