학교체육 활성화를 위한 입법적 개선방안 연구

국문 초록

학생의 체육활동 강화 등의 입법 목적을 가지고 「학교체육 진흥법」이 제정 및 시행된 지 10여 년이 흘렀다. 학교체육의 중요성에 대한 사회적 관심은 점차 증가하고 있으나 과연 동법이 이러한 관심에 제대로 대응할 수 있는 체계를 가지고 있는지는 의문이 아닐 수 없다. 학교체육이 보다 활성화되기 위해서는 다음과 같은 점에서 입법적 개선이 요청된다. 첫째 , 학교체육에 관한 양적 기준, 측 시수는 학교체육에 관한 득벌법에 해당하는 「학교체육 진흥법」에서 명문으로 규율함으로써 규범력을 제고할 필요가 있다. 또한 학교체육이 아니고서는 학생들의 신체활동 기회를 담보할 수 없는 우리의 특성을 감안하여 학교체육의 시수를 외국의 기준과 상응하게 또는 그 이상으로 증대하는 것이 요청된다. 둘째, 학교체육 내실화 관련 규정들의 경우 단순히 의무를 확인하는 수준에서 머물 것이 아니라 해당 의무를 충실하게 준수할 수 있도록 세부적인 기준들을 하위법령 등을 통해 마련할 필요가 있다. 법령에서 정한 각종 사항들이 제대로 이행되고 있는지 점검하기 위하여 사전적으로 학교체육 현황에 대한 구체적인 조사가 실시될 수 있도록 법적 근거를 마련하는 한편, 이를 토대로 하여 이행 실태를 점검하고 부족한 부분에 대하여는 시정 또는 개선 명령을 할 수 있도록 규율할 필요가 있다. 셋째, 여학생 및 장애학생의 학교체육에 대한 수요가 일률적이지 않다는 특성 등을 감안하여 구체적인 방안은 자율에 맡기되 이행점검 및 제재수단을 마련하는 방법을 마련할 필요가 있다. 이행점검의 경우 자체평가 등을 통해 자체적으로 마련하여 운영하도록 하는 한편, 외부 전문기관 등에 의해 점검하고 법령에서 정한 의무 이행에 충분하지 않은 경우 개선 명령 등을 부과할 수 있도록 하는 것이 적절할 것이다.

영문 초록

More than 10 years have passed since the Physical Education Promotion Act was enacted and entered into force in order to improve students' physical activities. Social interest in the importance of physical education is gradually increasing, but it is questionable whether the law can effectively respond to this interest. In order for school sports to become more active, the Act should be revised as follows. First, the quantitative standards on physical education should be clearly articulated at the Physical Education Promotion Act. Also, taking into account the social circumstance of not being able to guarantee physical activity opportunities for students without physical education, it is necessary for increasing the number of school sports sessions. Second, in the case of regulations related to the improvement of school physical education, it is necessary to establish detailed standards through subordinate laws and regulations to ensure faithful compliance with the obligations, rather than simply confmning the obligations. In order to check whether various matters stipulated in the law are being properly implemented, a legal basis is established so that a detai led inspections on the current status of school sports can be conducted in advance, and based on this, the implementation status is checked and any shortcomings are ordered to be corrected or improved. Third, taking into account the fact that the demand for school physical education among female students and students with disabilities is not unifonn, it is necessary to leave specific measures to the autonomy, but to prepare a method to check implementation and provide sanctions. In the case of monitoring, it would be appropriate to prepare and operate it in-house through self-evaluation, etc., while inspecting it by an external special i쩍 agency, etc. and imposing an order for improvement if it is not sufficient to fulfi ll the obligations stipulated in the law.
