데리다(Jacques Derrida)의 정의론에 관한 법철학적 연구

국문 초록

법의 이념은 정의(justice)이다. 이 정의는 법과 판결을 통해서 구체화되고 실현된다. 그러나 ‘제정법 된 법’과 이 법의 적용되는 ‘사안(case)’에는 시간적 간극이 존재한다. 이 간극은 ‘미래’라는 시간적 차원의 문제이다. 따라서 법의 이념인 정의를 온전하게 실현하기 위해서는 이 간극을 고려해야 한다. 그렇기 때문에 법의 정의 탐구는 정의의 본질 탐구뿐만 아니라 시간 차원에서 정의를 고려해야 한다. 정의를 시간적 차원에서 탐구하고 법에 적용하기 위하여서, 이 문제를 데리다의 해체론적 정의이론을 통해 탐구하려고 한다. 특히 데리다의 저서인 『법의 힘』을 중심으로이 문제를 다루겠다. 해체적 정의론의 중요 개념인 ‘차연(différance)’, ‘아포리아(aporia)’, ‘결정 불가능성(undecidability)’을 나침판으로 삼아 『법의 힘』을 탐구한다. 그리고 법의 구체적인 적용을 위해서 판결에서 판결의 해체와 해체의 판결, 현재의 법은 어디로?, 결정의 불가능성과 법의 결정 가능성, 법의 정합성, 판결에서의 계산 불가능성과 계산 가능성의 입맞춤을 살펴본다. 이를 통해서 본 글은법적 정의는 계산 가능성의 합리성만이 아니라, 계산의 판단 중지, 계산 불가능성, 결정의 광기를 포함하고 있으며, 이를 통하여서 법의 보편성과 사안의 고유성문제가 해결되고, 법적 정의는 현재적 정의 안에 이미 전미래시제의 정의가 포함되어 있으며, 법의 정합성 역시 이 미래적 시간차원까지 포함되어 있음을 제시한다.

영문 초록

The central idea in law is justice. This concept of justice is given concrete form and realized through the law and the judicial decisions made in courtrooms. However, there is a temporal gap that exists between the enacted law and its application to specific cases. This gap is a problem of the temporal dimension known as “the future”. Therefore, in order to fully achieve justice, which is the ideology of law, this temporal gap must be taken into account. Consequently, the investigation of the definition of law involves not only the exploration of the essence of justice but also the consideration of justice in the temporal dimension. To explore justice in the temporal dimension and apply it to law, this article proposes to examine the problem through Derrida's deconstructive theory of justice. Specifically, the article focuses on Derrida's book Force of Law to investigate this issue. Using important concepts of deconstructive justice theory such as “différance,” “aporia,” and “undecidability” as a compass, Force of Law is analyzed. In addition, to apply law in a concrete manner, the article examines the deconstruction of judgments, the judgment of deconstruction, where current law is heading, the impossibility of decision-making and the possibility of law's decision-making, the consistency of law, and the matching of calculation impossibility and possibility in judgments. Through this examination, the article argues that legal justice includes not only the rationality of calculability but also the suspension of judgment in calculation, the impossibility of calculation, and the madness of decision-making. This approach can help to resolve the issue of the universality of law and the specificity of cases, indicating that legal justice already includes the justice of the entire past and future in the present definition of justice, and that the consistency of law includes the future temporal dimension.
