사회복지의 법적 실천에 관한 탐색적 연구

국문 초록

그동안 우리나라에서 사회복지의 전문성은 미시적 사회복지실천에 중심을 두고 발전시켜왔다. 그러나 ‘사회복지법제’ 교과목이 ‘사회복지법제와 실천’으로 변경되면서 거시적 사회복지실천으로서 사회복지의 법적 실천이 사회복지의 전문성 중 하나가 되는 시대가 되었다. 하지만 사회복지의 법적 실천에 관한 연구는 매우 미진한 상황이다. 일부 진행된 선행연구는 사회복지사가 수행할 수 없는 또는 수행할 필요가 없는 법적 실천까지를 제시하거나 매우 단편적으로 법적 실천의 방향성만 제시하고 있는 수준이어서 한계가 있다. 따라서 본 연구는 선행연구의 한계점을 극복하여 사회복지 법적 실천의 내용을 구체화하여 사회복지 현장에서 사회복지사가 법적 실천을 실질적으로 활용할 수 있도록 하는 데 목적이 있다. 사회복지사는 법 전문가가 아니기 때문에 사회복지 전문가로서 사회복지가 추구하는 목적을 효과적으로 달성시킬 수 있는 수준에서만 법을 활용하면 된다. 이에 따라 본 연구는 사회복지사가 활용할 수 있는 법적 실천을 3가지로 제시하였다. 첫째, 클라이언트의 권리보장을 위한 법적 실천이다. 클라이언트의 사회복지에 관한 권리의 내용을 이해하고 클라이언트 스스로가 이를 주장할 수 있도록 하며, 만일 권리가 침해되었을 경우 이를 되돌릴 수 있도록 절차를 통해 구제받을 수 있도록 할 필요가 있다. 둘째, 사회복지사의 책임과 의무를 위한 법적 실천이다. 사회복지사는 법에 따른 역할과 기능을 정확히 파악하여 그 임무를 수행해야 할 것이며, 책임과 의무에 있어서 해야 할 것과 금지할 것을 구분하여 준수해야 할 것이다. 특히 벌칙 대상이 되지 않도록 주의가 요구된다. 셋째, 사회복지제도 변화를 위한 법적 실천이다. 사회복지가 공식적이고 제도적으로 작동되도록 관련 법 제정을 위한 역할 수행과 소송을 통해 사회복지가 추구하는 목적으로 변화를 이끌어야 한다. 결론적으로 사회복지는 법을 통해 실천되고 법과 함께 실천된다고 볼 수 있다. 그러므로 사회복지의 법적 실천은 사회복지의 거시적 사회복지실천으로서 전문적으로 연구되고 실천되어야 한다.

영문 초록

The specialty of Korean social welfare has been that, it is developed with a focus on micro-social welfare practices. However, as the course of ‘Social Welfare Law’ changed to ‘Social Welfare Law and Practice,’ as an example of macro level social welfare, the legal practice of such a welfare has become one of its specialties. However, research on the legal practice of social welfare remains significantly insufficient. This limitation exists because, some of the previous studies present legal practices that social workers cannot or do not need to perform, or they are at a level that suggests the direction of legal practice in an extremely fragmented manner. Accordingly, the purpose of this study is to enable social workers to practically use legal practices in the social welfare field, by overcoming the limitations of previous studies, and refining the contents of social welfare legal practices. Since social workers are not legal experts, they should only use the law at the level that can effectively achieve the goals pursued by social welfare experts. Accordingly, this study presented three legal practices for social workers’ ease of usage. First, it is a legal practice to guarantee the clients’ rights. There is a need to understand the contents of the client’s rights regarding social welfare, and enable the client to assert them himself. In the case of a right’s infringement, it is necessary to provide a remedy through the procedure for its reversal. Second, it is a legal practice to identify the responsibilities and obligations of social workers. Social workers should accurately identify the roles and functions according to the law, and carry out their duties. In terms of responsibilities and obligations, these should be executed by distinguishing between what is to be performed and what is to be prohibited. In particular, being subject to penalties should be cautiously avoided. Third, it is a legal practice to change the social welfare system. There is a need to lead change towards the purpose pursued by social welfare, through litigation and enacting related laws, such that social welfare works formally and institutionally. In conclusion, social welfare can be realized through the law and along with the law. Thereby, legal social welfare should be examined, and carried out professionally as a macro social welfare practice.
