국문 초록

성범죄의 피해자를 비난해선 안 된다. 성범죄와 관련해 비난받아 마땅한 이 는 피해자가 아닌 바로 가해자이다. 이 글의 목표는 이 분명한 이유 외에 피해자를 비난하지 말아야 할 또 다른 이유를 제시하는 데 있다. 이 글이 제시할 보호 설명 에 따르면, 성범죄는 피해자에게 수모를 주며, 그의 자유를 박탈하고, 성차별적이라 는 점에서, 우리는 서로를 이 범죄로부터 보호해야 할 도덕적 이유를 갖는다. 특히 나 이 도덕적 이유에 따라 행동했다면 피해자가 사고를 피할 수 있었기에, 우리는 성범죄의 피해자를 비난해선 안 될 도덕적 이유를 갖는다. 본 논문은 보호 설명 외 에도 피해자 비난에 관한 수치심 설명과 호도 설명을 소개한다. 수치심 설명에 따 르면 비난은 성범죄 피해자에게 수치심을 주기에 적절하지 않으며, 호도 설명에 따 르면 피해자 비난은 가해자가 실제보다 작은 도덕적 책임만 갖는다고 호도하기에 정당화될 수 없다. 본 논문은 이 두 설명이 갖는 한계를 피할 수 있다는 점을 제시 해, 보호 설명이 이들에 대한 성공적 보완책이 될 수 있단 바를 입증해 보인다.

영문 초록

It is wrong to blame the victims of sexual assaults. One obvious reason why victim-blaming is morally impermissible is that regarding the incidents the victims are not blameworthy at all. This paper aims to provide another reason not to blame sexual assault victims. According to the protection account, which this paper suggests, people have moral reasons to protect one another from sexual assaults. In particular, if people did what they had moral reasons to do (i.e., protecting other people from sexual assaults), then the victims could have avoided the incidents. This is one of moral reasons why people should not blame sexual assault victims. To show a strength of the protection account, this paper introduces the humiliation account and the misleading account. According to the humiliation account, victim-blaming is problematic because this speech-act makes the victims feel ashamed. On the contrary, according to the misleading account, blaming is impermissible because this speech-act misleads others to believe that the culprits are blameworthy less than they actually are. This paper argues that the protection account can avoid a problem which these accounts encounter.
