공중보건모델에 따른 소년범죄 예방대책에 관한 고찰

국문 초록

본 연구는 최근 사회적 문제가 되고 있는 각종 소년범죄의 원인을 분석하고자 생물심리사회적 모델에따라 선행연구를 이론적으로 정리하였다. 이를 기반으로 소년범죄의 실태를 살펴보고 그 특징을 고찰하였다. 그리고 그 특징을 바탕으로 소년범죄 예방을 위해 도입할 수 있는 현실적인 방안을 마련하는데목적이 있다. 소년범죄의 실태와 특징을 살펴보고자 경찰청, 대검찰청, 법무연수원, 교정본부의 각종범죄관련 통계 등 문헌을 연구하였다. 소년범죄의 특징은 첫째, 초범의 비율이 증가하고 있어 가정과학교 등 1차적 예방이 중요하다. 둘째, 우발적･즉흥적･충동적인 행동양식에 따른 범행동기가 많아사회성 향상을 위한 노력이 요구된다. 셋째, 재산범죄는 단순절도에서 지능적인 사기, 횡령 등으로다변화되고 있다. 소년범죄의 예방대책은 공중보건모델을 적용한 단계별 구조에 따라 기존 연구자료및 각종 위원회 등에서 제시하고 있는 정책 자료를 고찰하여 도출하였다. 구조화된 단계별 대책은다음과 같다. 첫째, 공중보건모델에 따른 1차적 예방대책으로는 건강가정지원센터 운영의 활성화, 학교폭력대책자치위원회 운영의 효율화, 회복적 학교생활교육 운영의 활성화 등이다. 둘째, 2차적예방대책으로는 경찰단계 다이버전 제도의 내실화, 검찰단계 다이버전 제도의 내실화, 법원단계 다이버전 제도 운영의 내실화, 법원의 임시조치제도의 실질적 내실화 등이다. 셋째, 3차적 예방대책으로는교정시설 소년수용자 사회복귀 역량 강화, 정신장애 소년범죄인 등에 대한 지원체계 구축, 사회내보호제도 활성화 등이다.

영문 초록

In order to investigate the causes of juvenile delinquency in recent years, this study theoretically summarized previous studies based on biopsychosocial models. Based on this, we investigated the actual situation of juvenile delinquency and examined its characteristics. Based on these characteristics, the aim is to develop practical measures that can be introduced to prevent juvenile delinquency. In order to investigate the actual conditions and characteristics of juvenile delinquency, we have studied literature such as various crime-related statistics by the National Police Agency, Supreme Prosecutors Office, Institute of Justice, and Correctional Service. The first characteristic of juvenile delinquency is that the rate of first offenses is increasing, and primary prevention such as at home and school is important. Second, there are many reasons for committing crimes based on accidental, improvisational, and impulsive behaviors, and efforts to improve social character are required. Third, property crimes have diversified from simple theft to intelligent fraud and embezzlement. Juvenile delinquency prevention measures were derived by considering existing research and policy materials presented by various committees, and based on a step-by-step structure to which the public health model is applied. Structured step-by-step measures are as follows: First, the initial preventive measures based on the public health model are to revitalize The Health and Family Support Center, improve the efficiency of The School Violence Countermeasures Committee, and revitalize school life education. Second, secondary preventive measures are to enhance the police, prosecution and court stage diversion systems, and to strengthen the court s temporary measures system. The third preventive measures include strengthening the rehabilitation capacity of juvenile inmates at correctional facilities, and establishing a support system for juvenile offenders with mental illness.
