다문화사회의 외국인범죄 증가에 대한 대응방안

국문 초록

본 연구는 다문화사회의 외국인범죄 증가에 대한 대응방안을 탐색하는 데 목적을 두고 있다. 연구방법은 외국인범죄에 대한 선행연구들과 관련기관의 통계자료들을 분석하였다. 또한 본 연구는 외국인범죄의 발생원인, 범죄 유형, 범죄 특징 및 외국인범죄 감소 방안을 모색하였다. 연구 결과를 살펴보면다음과 같다. 첫째, 외국인범죄 원인은 개인적 원인, 사회문화적 원인, 경제적 원인으로 나누어 살펴보았다. 둘째, 외국인범죄 유형은 불법체류외국인 노동자와 재외동포들의 국내 방문 취업에서 발생하는범죄 유형이 있었다. 또한 교육수준이 낮은 단순 노동자에 대한 사회적 차별과 경제적 어려움에서범죄로 이어지는 사건들이 증가하였으며, 교통범죄, 폭력범죄, 절도범죄 등이 범죄의 절반을 차지함을알 수 있었다. 셋째, 외국인범죄의 특징은 갈수록 집단화와 조직화되는 경향을 보였으며, 특히 외국범죄조직과 연계하는 등의 강력범죄가 늘어났다. 또한 내국인과 달리 외국인은 외견상 구별이 쉽지 않고의사소통의 어려움 등으로 증거수집과 검거에 어려움이 있는 것으로 나타났다. 특히 저임금과 고용주의폭행 등 차별과 편견으로 인한 분노가 범죄로 이어지는 경우가 많았다. 다섯째, 외국인범죄 감소를위한 대응방안은 다음과 같다. 첫째, 강력한 처벌이다. 둘째, 국내에 입국한 외국인에 대한 체계적인자료 구축이 필요하다. 셋째, 다문화사회에 대한 국가적 차원의 정책 수립이다. 넷째, 외국인범죄에대한 전담부서의 마련과 인력확충이 필요할 것으로 보인다. 다섯째, 다문화사회에 대한 국민정서가외국인 노동자들을 이해하고 포용할 수 있는 선진화된 문화의 정착이 필요하며 외국인범죄가 발생하기전에 예방하는 것이 우선되어야 할 것으로 여겨진다.

영문 초록

This study examined countermeasures on the increase of crimes committed by foreigners in multicultural societies. The research method analyzed prior studies on crimes committed by foreigners and statistical data from related institutions. The study also sought causes of crimes committed by foreigners, the types of crime, their characteristics, and ways to reduce foreigner committed crime. The research results are as follows: First, the causes of foreigner offenses were divided into personal, socio-cultural, and economic causes. Second, the crimes were committed by illegal foreign workers and overseas Koreans. Also, because of social discrimination and economic difficulties, workers of low educational levels led to crimes like traffic violations, violent crime and theft. Third, the characteristics of crimes committed by foreigners have tended to be increasingly grouped and organized, especially in connection with foreign crime organizations. In addition, unlike crimes committed by Koreans, evidence collection and arrests are problematic due to difficulties in communication. In particular, low wages and assault by employers often led to crime. Fifth, countermeasures are as follows: One, a strong punishment is necessary. Two, it is necessary to establish systematic data on foreigners who enter Korea. Three, there needs to be a national-level policy on multicultural societies. Four, it seems necessary to prepare a dedicated department for foreigner related crime and expand manpower. Five, it is necessary to establish an advanced culture that can understand and embrace foreign workers. Above all, prevention of crimes committed by foreigners is necessary.
