법정후견 사례 분석을 통한 임의후견의 이용 및 활성화 방안

국문 초록

2011. 3. 7. 개정 민법에서는 자기결정권의 존중, 잔존능력의 활용, 정상화 이념 등의 실현을 위한 성년후견제도를 도입하였다. 성년후견제도는 후견인과 후견의 내용 등이 법원의 심판을 통하여 개시되는 법정후견과 후견인과 후견을 받을 사람 간의 후견계약으로 이루어지는 임의후견으로 구분되며, 그 중 임의후견은 본인의 정신 능력이 부족할 상황을 대비하여 본인의 재산관리 및 신상보호에 관한 사무의 전부나 일부를 타인에게 위탁하고 대리권을 수여하는 내용의 후견계약을 체결하고 임의후견감독인을 선임한 때에 효력이 발생하게 된다. 조만간 우리나라의 초고령사회로의 진입이 예상되고, 치매 등 정신적 장애가 있는 노인과 장애인이 지속적으로 증가하고 있는 상황에서 임의후견의 이용 및 활성화는 피후견인의 사적 자치와 자기 결정의 존중 이념을 충실하게 실현할 수 있는 방안이 될 수 있다. 이에 (사)한국성년후견지원본부가 전문가 후견인으로 선임된 법정후견 사례 중 임의후견과 관련 있는 사안을 살펴보고, 그 분석을 통하여 임의후견의 이용 및 활성화 방안을 도출해보고자 한다. 임의후견 이용의 활성화를 위한 제안으로 잠재적 이용자의 접근성과 제도개선을 통한 이용성 제고를 꾀하는 노력이 요구되고, 구체적 방법으로 제도 홍보 및 교육, 표준후견계약서 양식 개선 및 작성지원, 임의후견 수임자 양성 등과 피후견인의 의사능력 문제와 연관된 공증인의 역할, 장애 있는 성년자의 대리인을 통한 후견계약 체결, 후견신탁 활용 등이 수반될 필요가 있다.

영문 초록

In the revised Korean Civil Law on March 7, 2011, an adult guardianship system was introduced to realize the respect of self-determination rights, the utilization of residual capabilities, and the ideology of normalization. The adult guardianship system is divided into court guardianship and voluntary guardianship contracts between guardians and guardianship recipients, among which all or part of their property management and personal protection affairs are entrusted to others and appointed a voluntary guardian. With Korea s entry into the ultra-aged society soon and the number of mentally disabled and disabled people such as dementia continuously increasing, the use and activation of voluntary guardianship can be a way to faithfully realize the ideology of private autonomy and self-determination. Accordingly, The purpose of this study is to examine the cases related to voluntary guardianship among the cases of legal guardianship in which The Korean Support Center for Guardianship System was appointed as an expert guardian, and to derive a plan for using and activating voluntary guardianship through the analysis. As a proposal to promote the use of voluntary guardianship, efforts are required to improve accessibility of potential users and usability through system improvement. It is necessary to accompany the role of a notary public in relation to the problem of medical ability, conclusion of a guardianship contract through a representative of an adult with a disability, and use of a guardianship trust.
