국문 초록

우리나라의 사회경제, 체육사업의 발전 및 정치체제개혁의 심입, 정부직능의 전환에 따라 우리나라의 체육사업은 계획경제로부터 시장경제로의 전변과정에, 자율성이 부단히 제고되었고, 원유의 운동항목관리체제는 이미 체육사업발전의 수요에 적응될수 없게 되었으며1), 체육업무협회가 시대의 요구에 의해 나타났다. 체육업무협회는 출현된후, 체육운동의 전개, 체육사업의 국제적교류와 합작, 민중건강수준의 제고 등 방면에서, 거대한 작용을 발휘하였다. 그러나, 우리나라 시장경제개혁이 점차 심입되고 체육사업의 산업화정도가 심화됨에 따라, 우리나라체육업무협회는 운행중에서 많은 잠복되었던 문제들이 노출되었으며, 체육업무협회의 작용발휘에 엄중한 영향을 주었다. 그러므로, 본 문장에서는 우리나라 체육업무협회의 현상황, 특점, 법률적속성 등 몇가지 방면에 대한 연구를 통하여, 우리나라 체육업무협회에 존재하는 법률문제를 분석하고, 그에 관한 건의를 제출함으로서, 우리나라의 체육법의 개정, 및 체육업무의 발전에 대하여 이론적지지를 제공하고저 하는 바이다.

영문 초록

随着我国社会经济、体育事业的发展，以及政治体制深入改革、政府职能的转换，我国体育事业在由计划经济向市场经济转变的过程中，自律性不断提高，原有的运动项目管理体制已难以适应体育事业发展的要求1)，体育行业协会应运而生。体育行业产生后，在开展体育运动，促进体育事业国际交流与合作，提高人民群众健康水平等方面，发挥了巨大作用。但随着我国市场经济改革的逐步深入以及体育事业产业化程度的加深，我国体育行业协会在运作过程中暴露出许多深层次的问题，严重影响体育行业协会作用的发挥。故而本文主要通过对我国体育行业协会的现状、特点、法律性质等几方面探讨，分析我国体育行业协会存在的法律问题， 并提出相关建议，以期对我国体育法的With social economy development as well as the government function transformation in the country , the original sports management system is difficult to adapt the request of the development of sports enterprise in the process which the planned economy transforms to the market economy. The sports profession association arises at the historic moment . When the sports profession association established, it has played a great role in several aspects, such as developing athletic sports, promoting international exchange and cooperation of the sports enterprise and so on. But now the market economy reform is strengthening gradually as well as the degree of the industrialization of sports enterprise is deepening, which seriously affects the function of the sports profession association. This article analyzes the legal matter that the sports profession association exists through studying several aspects about the country’s sports profession association, such as its present situation , characteristic, legal nature and so on. It also propose correlation suggestion , which purpose is providing theoretic supports to the revision of the sports law and the sports profession association’s development. The profession association generally refers to a social group, which is constituted by people who is engaged in homogeneous profession. They have common interests and goals. Such social group is founded to protect common interest and maintain each kind of criterion. As one kind of profession associations, sports profession association has inherent quality and legal characteristic of it. But because sports enterprise is a commonweal, the sport profession association has its own characteristic, which is different from general trading profession association in several aspects, such as establishment goal, operating mechanism, funds origin and so on. The sports profession association is the outcome of sports system reform in the country, which is established gradually according to administrative order from the top downward. With the adjustment of the national organization as well as the transformation of government function, the sports pattern is socializing gradually. At the same time various single items sports profession association is founded one after another. The sports profession association all over the world mainly have two kinds of management patterns : the “people management ” pattern and the “politics society condominium ” pattern , but no matter what kind of management pattern it is ,the sports profession association is a independent social group ,which has legal personality .
