국문 초록

본 연구의 목적은 안전의식 제고 및 중대사고 예방 그리고 선수보호와 관리에 도움을 줄 수 있는 기초자료를 제공하여 스포츠현장에서 선수기량을 최대한 발휘할 수 있는 환경을 조성하고 법적 분쟁을 방지하는데에 있다. 본 연구 방법은 문헌조사 방법으로서 해방이후 2005년 7월31일 현재 엘리트스포츠 현장에서 발생한 중대사고(사망, 폐질 등)를 조사 고찰하였으며 연구 결과는 다음과 같다. 스포츠현장에서 발생한 중대 사고자는 모두 74명(사망 58명, 폐질 16명)으로서 사고자 74.5% 이상은 10대에서 20대 연령의 남자선수로서 주로 고등학생들에게 사고의 발생률이 높게 나타났다. 연대별로 볼 때 전년대에 비해 배 이상 증가하는 추세를 보였다. 직접적인 운동관련 사고에서 훈련 중에 사고 발생률이 경기 중보다 높게 나타났으며, 사망원인은 교통사고(19명), 가격․타격․충격사고(17명), 추락사고(14명), 익사(10명), 돌연사(9명), 체중감량사고(3명), 그리고 가스폭발과 압박사고(각 1명)의 순으로 나타났다. 운동종목별 주요 사고원인으로는 단체경기에서는 머리부상과 심폐정지 사고였으며 개인경기에서는 추락관련 사고와 교통사고, 익사사고 등의 안전사고였고, 대인경기는 뇌손상 사고와 체중감량사고로 나타났다. 사고발생 인원수는 사이클(11명), 복싱(7명), 야구․카누․체조(각 5명), 럭비(4명), 축구․경륜․육상경기․조정․레슬링․유도․태권도(각 3명), 배구․경마․수영․씨름(각 2명) 그리고 아이스하키․승마․다이빙․쇼트트랙․스키․피겨․무에타이․이종격투기(각 1명) 순으로 나타났다. 중대사고 방지를 위한 자료축적을 위해서는 각 종목에서 발생한 사고 중 중대사고에 대해서는 보고를 의무화할 수 있는 행정체계가 수립되어야 하며 책임 있는 상위부처(문화관광부 체육국, 대한체육회 등)에서는 기본 직무로서 중대사고에 대한 통계치를 보존 유지토록 규정화할 필요가 있다. 또한 발생한 사고에 대해서는 철저한 원인규명과 함께 사고사례를 홍보하여 유사한 사고가 발생치 않도록 해야 하며 이를 위해서는 책임 있는 상위부처에서는 중대사고 재발방지를 위해 정확한 사고원인을 밝힐 수 있도록 사고조사 위원회를 설치 운영해야한다. 위원회의 구성은 사고관련 법학자, 체육학자, 사고발생 종목의 협회 관계자 및 일선 지도자 등으로 하되 외부인사를 중심으로 구성하여 객관성과 공정성 그리고 중립성을 유지토록 한다.

영문 초록

In looking into causes of serious accidents occurred in sports circumstances in South Korea, most of those were due to the absence of fundamental points like an insufficiency of preventive perceptions of coaches and staffs and a carelessness of management of athletes, an absence of rescue equipments and emergency systems, not to inevitable causes. Also, when the accidents were occurred, responsible relative organizations or associations must take complementary measures with critical investigation of the causes of accidents in order not to be occurred again. However, those didn t have enough records or statistics about the serious accidents had been occurred by now. Therefore, a clear grasp of the present regarding kinds of accidents occurred in sports circumstances was presented as the problem above all. This study was to prevent the legal conflict by the close examination and investigation of accidents in sports circumstances for elite sports and to provide basic data which were helpful for the promotion of safety-perceptions, prevention against serious accidents, preservation and management of athletes in order to establish circumstances that athletes were able to do their best. This study was aimed at professional sports, athletes, and coaches which had registered for sports associations affiliated with Korea Sports Council from the liberation from Japan in 1945. The method of this study was a research of the literature on national news, articles and judical precedents. The articles from Chosun Il-bo and Chungang Il-bo from 1945 to 31, Dec, 1989 and from KINDS, Korean article browsing web site, from 1, Jan, 1990 to 31, Jul, 2005 were used as data in this study. Also, compact discs and sport-related judical reports gathered in the library of law court were analysed for national cases. The serious accidents presented in this study were game-related and training-related accidents, the subjects of this study limited to the deaths, patients with general or lower half of body paralysis who have to be lived as people with disability for the rest of life, amputees, the blinds, except people, who had been injured, with no problem to live at present normally. Besides, if the articles didn t make a report of any profile of people died and injured by accidents, they were excluded in the process of calculating the number from this study. Because of this reason, there would be differences between the real numbers of people died and injured by accidents and the cited numbers of people in this study. The results of this study were as follows.
