한국 전통무예의 헌법상 지위 고찰

국문 초록

본 연구는 헌법상 권리측면에서 한국 전통무예의 지위를 제고하기 위해 택견을 중심으로 고찰하였다. 이를 위해 전통무예와 관련된 법률, 헌법상 기본권 조항, 헌법재판소 판례, 택견을 주제로 한 논문 등 문헌을 고찰한 결과 다음과 같은 결론에 도달하였다. 첫째, 현행헌법에서는 전통무예와 관련된 규정이 없으므로 헌법 제37조 제1항을 근거로 전통무예에 관한 권리와 기본권 조항을 조화롭게 해석해야 한다. 둘째, 전통무예는 헌법상 문화적 기본권으로서의 지위를 갖고 있으며 그 근거로서 헌법전문과 헌법 제9조 전통문화와 민족문화, 제10조 인간의 존엄성과 기본인권보장, 제69조 대통령의 취임선서 등을 들 수 있다. 셋째, 전통무예는 헌법상 자유권적 기본권으로서의 지위를 갖고 있으며, 개별적 권리로서 헌법 제12조 1항 신체의 자유권, 제14조 거주·이전의 자유권, 제15조 직업의 자유권, 제21조 제1항 집회·결사의 자유권, 제22조 제1항 학문의 자유권 등이 있다. 넷째, 전통무예는 헌법상 사회적 기본권으로서의 지위를 갖고 있으며, 개별적 권리로서 헌법 제31조 제1항 교육을 받을 권리와 제36조 제3항 보건에 관한 권리가 있다. 현재 문화적으로 가치 있는 전통무예를 진흥하고자 전통무예진흥법과 시행령이 제정되었으나 전통무예종목 선정과 관련한 무예단체 간의 갈등과 전통무예진흥법 시행규칙이 제정되지 않고 있어 아직도 구체적인 시행을 보지 못하고 있다. 전통무예 중 유일하게 택견이 문화재보호법에 의해 문화재로서 보호를 받고 있으나 이는 현존하는 전통무예의 수와 전통무예가 지니고 있는 다양한 사회적 가치에 비하면 매우 미약하다고 판단되며, 전통무예진흥법 시행규칙 제정 방안을 비롯한 권리 측면에서의 전통무예에 관한 연구가 더욱 활발하게 이루어져야 할 것이다.

영문 초록

This study is to find out the constitutional status of the korean traditional martial arts focused on Taekkyon by the methodology of analyzing documents. To raise the status of the traditional martial arts in the right aspect, I examined the articles and clauses about the general right on the Constitution, the cases of the Constitutional Court and several theses which were related taekkyon. The results are as follows: First, they did not institute the articles and clauses about traditional martial arts and ‘taekkyon’, thus we need to construe harmoniously the rights related with traditional martial arts and the articles of the General Rights on the base of Article 37(1). Second, traditional martial arts has the status of the cultural right under the Preamble to the constitution, Article 9 ‘traditional culture & national curture’, 10 ‘human dignity & guarantee fundamental human rights’, and Article 69 ‘inauguration oath of the President’ in the Constitution. Third, traditional martial arts has the status of the civil liberties under the Article 12 ‘personal liberty’, 14 ‘freedom of residence’, 15 ‘freedom of occupation’, 21(1) ’freedom of assembly and association’ and Article 22(1) ‘freedom of learning’ in the Constitution. Fourth, traditional martial arts has the status of the social rights under the Article 31(1) ‘right to receive education’ and 36(3) ‘the right of health’ in the Constitution. They have enacted the Traditional Martial Arts Promotion Law and an Enforcement Ordinance to promote traditional martial arts being worth in culture. But they didn t put in force the law yet because they didn t enact the Enforcement Regulation and conflicts between the martial arts groups about being made select as a body. Taekkyon is the only item being under the protection of the Cultural Properties Protection Law. But there are lots of martial arts which are worth being protected in Korea. I think we need to study lively from the aspect in rights of traditional martial arts.
