국문 초록

스포츠는 개개인의 건강증진 외에도 삶의 질을 높이고 문화적인 생활을 유지하려는 목적으로하는 활동이다. 최근 전문가에 의한 스포츠활동 뿐만 아니라 일반국민에게도 대중스포츠를 통한여가활동이 활발해지면서 스포츠안전사고의 가능성은 더 높아져 가고 있다. 최근 스포츠안전사고를 보험에서 위험으로 인식하여 다양한 보험의 목적을 스포츠보험으로 인수하고 있다. 생활체육의활성화에 따라 스포츠안전문제가 전문체육분야에서 생활체육분야로 확대되어 저변확대에 따른 스포츠안전사고에 대한 인식의 변화가 특별히 필요하고 생활체육의 안정적인 정착을 위하여 스포츠보험이나 공제 등이 제도적인 안전장치로 확립할 수 있도록 해야 한다. 스포츠안전사고를 보험상 위험으로 인수한 민영회사 외에 공제회를 통하여 위험을 인수하는 경우가 있다. 최근 스포츠안전재단에서 운영하고 있는 스포츠안전공제서비스가 보험과 비견할 수 있는 공제에 해당하는 지에 대하여 주목해볼 필요가 있다. 스포츠안전재단은 민법에 근거하여 설립한 재단으로 보험이나 공제를 운영할 법적인 근거를 가지고 있지 아니한 단체인 것으로 파악된다. 스포츠안전재단의 주무관청은 문화체육관광부로서 공제와 관련한 일련의 서비스운영에 대하여 감독을 하여야 하는 주체이다. 보험의 경우는 금융감독원 등을 통한 감독이 이루어지지만, 공제는 실제로 감독의 사각지대에 있다고 비판의 소리가 높다. 스포츠안전재단에서 운영하는 스포츠안전공제서비스의 실체가 보험업에 의한 것도 아니고 공제사업에 의한 것도 아닌 일명 공제서비스라는이름하에 스포츠안전사고에 대한 위험인수를 대상으로 하고 있어서 과연 이러한 서비스제공이 합법적인 자격에 의한 것인지를 판단하여 사회안전망으로서의 제 역할을 수행할 수 있도록 철저한분석이 필요하다.

영문 초록

Sports activities have the purpose of keeping the cultural life in addition to individual health promotion to improve the quality of life. These leisure activities will be increased through sports activities in recent public. Also it is increasing the possibility of sports accidents. So the Insurance companies attempt to take over the risk of sports accidents. Sports safety issues in accordance with the activation of the athletic field is expanded to public sport it requires a change in awareness of the particular sports accidents. For the stable settlement of public it should ensure that sports can be established, such as insurance or mutual benefit association with institutional safeguards. Recently, it is necessary to find out whether the means which can be compared the sports safety mutual benefit service operated by the korea sports safety foundation with sports safety insurance. But the Korea sports safety foundation seems to have no legal basis, to operate insurance. The competent authority is the Ministry of Culture, Sports and Tourism of the korea sports safety foundation, an entity that should be directed against the operating service associated with sports. In the case of insurance companies is subject to the supervision of the Financial Supervisory Service. On the other hand, there is criticism that the sports safety mutual benefit service is in the blind spot of directors. The entity of sports safety mutual benefit service is neither insurance nor mutual benefit service business. Therefore, the foundation should be determined whether a company can take the risk for sport accidents thorough the analysis that needed to establish a social safety net.
