체육단체 통합에 따른 법제도 개선의 방향

국문 초록

2015년 3월 3일 대한체육회와 국민생활체육회의 통합을 위한 국민체육진흥법 개정안이 국회 본회의를 통과한 이후, 양 체육단체의 조직통합 준비절차가 신속하게 진행되고 있다. 체육단체의 통합은 엘리트체육자원의 고갈, 엘리트체육과 생활체육의 단절, 학교체육의 위기와 같은 현행 체육계의 본질적인 문제점을 타개하기 위하여 진행되고 있다. 이 통합이 외피적 통합으로 그치지 아니하고 융합의 효과를 일으켜 우리나라 체육의 선진화와 활성화로 이어지기 위하여는 올바른 법적·제도적 개선이 뒷받침되어야 한다. 이에는 민주성제고의 측면, 공정성·투명성 제고의 측면, 체계정합성 그리고 나아가 사회통합의 측면에서의 개선을 위한 검토가 요구된다 하겠다. 나아가 이러한 통합된 체육회를 종합적이고 효율적으로 지원하기 위하여 스포츠관련법률을 정비하고 기본법 체계를구축하는 것이 필요하다고 본다. 법은 정책을 담는 그릇이다. 통합과 관련한 많은 정책을 이제 법이라는 그릇에 담아야할 때이다. 잘 갖추어진 법적 인프라를 기반으로 통합된 체육회가 엘리트체육과 생활체육, 학교체육의 안정되고 조화로운 삼각 구도를 그려내면서 새로운 스포츠 문화의 정체성을 만들어 갈 수 있기를 기대한다. 생활체육과 학교체육이 스포츠의 풍요로운 저변환경을 조성하고 이런 환경속에서 성장한 엘리트 스포츠선수들이 최고의 실력을 다져나가는 선순환 구조가 만들어져야 한다. 이는 학교체육, 생활체육과 엘리트 체육의 탄탄한 결합을 통해서만 이루어낼 수 있는 것이고 그 탄탄함은 법체계에의해 완성된다고 하겠다.

영문 초록

Since the amendment of National Sports Promotion Act for the integration of the “Korean Olympic Committee” and the “Korea Council of Sport for All” has passed the National Assembly on March 3, 2015, the integration preparing procedures of both sports bodies is in a rapid progress. The integration of sport organizations is proceeding to overcome the inherent problems of the current sportsdom such as resource depletion of elite sports, disconnection of sports for all and elite sports, and crisis of school physical education. For this integration to not just end up in a surface but to cause effect and lead to advancement and revitalization of Korean sports, proper legal/institutional improvement must be supported. This requires a review for the improvement on a side of democracy enhancement, fairness/transparency enhancement, system conformity, and social integration. Furthermore, in order to support this integrated sports body comprehensively and effectively, it is necessary to improve sports-related laws and establish basic law system. Law is a vessel for policy. Although myriads of policy suggestions related to this integration have been made until now, it is time to put them in the vessel in a form of law. Based on this well-structured legal foundation, a stable and balanced structure that can develop a new identity of sports culture is anticipated. Sports for all and school physical education should construct a productive environmental base and virtuous circulation for those athletes who are grown in this environment so that they are able to cultivate their full length of abilities. This can only be achieved by a solid union of school physical education, sports for all, and elite sports, and the solidity is completed under the legislative framework.
