국문 초록

최신 네트워크 기술은 새로운 미디어 등장의 기반이 되었으며 디지털 콘텐츠의 이용 방법과 콘텐츠 제작 환경에 많은 변화를 가져왔다. 특히 골프 종목 콘텐츠의 경우 이용자들이 간접 참여뿐 아니라 직접 참여하는 것도 가능하다는 점에서 최신 기술이 접목될 여지가 많아 더욱 많은 영향을 받으며 급격한 변화를 겪고 있다. 이 때문에 대부분의 골프 콘텐츠 제공자와 이용자들은 아직 저작권 인식이 모호한 상태이며, 저작권 침해여부를 스스로 판별하는 것도 어려운 실정이다. 스포츠 미디어 저작물 보호에 대한 법과 정책이 확립되지 않았다는 점도 혼란을 가중시킨다. 이러한 상태가 지속되면 콘텐츠 제작 예정자들은 진입에 어려움을 겪게 되고, 콘텐츠의 품질 및 이용률이 저하될 것이다. 저작권 제도는 예술·문화 등과 같은 분야의 발전을 도모하기 위해 창의적인 표현 활동을 장려하는 데 목적을 두고 있다는 점을 고려할 때, 산업 발전을 위해서는 콘텐츠 제작자 및 이용자가 저작권 문제로 어려움을 겪지 않도록 관련된 법과 정책에 대한 논의가 빠르게 이루어져야 한다. 본 연구에서는 골프 미디어 콘텐츠의 저작물이 올바르게 이용될 수 있도록 저작권법의 개선 방향에 대해 제언하고자 한다. 첫째로 골프 중계방송의 영상 저작권의 범위를 명확하게 명시해야 한다. 둘째로 콘텐츠를 제작하는 사이트 내 체계적인 모니터링 시스템을 작동하여 위반 행위를 적절하게 제재할 수 있도록 해야 한다. 이와 더불어 IT기술과 결합된 산업 활동까지도 포괄할 수 있도록 저작권법을 확대 제정할 필요가 있다는 점도 지적하고 있다.

영문 초록

Modern network technology has become the foundation for new media emergence and has brought many changes in the way of using digital content and the environment of content production. In particular, golf sports content is undergoing drastic changes as there is more room for the latest technology to be applied, given that users can participate directly as well as indirect participation. For this reason, most golf content providers and users still have a vague perception of copyright, and it is difficult to determine whether or not they infringe the copyright. The intellectual property protection of sports media has not been established laws and policies also add to the confusion. If this situation continues, prospective content creators will have difficulty entering and the content’s quality and utilization will be reduced. Considering that the copyright system is aimed at encouraging creative expression activities to promote the development of such areas as art and culture, for industrial development, discussions on relevant laws and policies should be made quickly so that content creators and users do not suffer from copyright problems. This study suggests the improvement of copyright law so that golf media content work can be used correctly. First, the range about the video copyright of the golf broadcast should be clearly specified. Second, a systematic monitoring system within the site that produces content should be operated so that violations can be properly sanctioned. It also points out the need to expand and enact copyright laws to cover even industrial activities combined with IT technology.
