영문 초록

Cberspace is the information space that is consists of Information and where is exchanged. Among many definitions of real estate digital information, it would be the most proper to define it as all kinds of data or knowledge that persons or the state, in connection with real estate activity or reality, has processed by optic, physical or electronic means and expressed in the forms of code, graphics, voice, sound or images. Real Estate Digital Information is consist of an electric wave and an flow of electricity and has not the personality. We can include the Real Estate Digital Informationin as the immaterial things which can be managed in the concept of things in Civil Law. The offer and the acceptance come into force under the Empfangstheorie. We has several problems. Firstly, there is the problem how we can make a distinction between the offer and the acceptance. All the conditions of transactions are presented by brokers in the sites of the Real Estate Electronic Transactions. We need to divide the types of the prices when the brokers present the prices. We can solve this problem through the division of it. Secondly, We need to settle the application of legal incompetence system in the Real Estate Electronic Transactions. We can accept the application of legal incompetence in the system of Civil Law because we have many procedures about accession, certification etc in the site of the Real Estate Electronic Transactions.
