국문 초록

오늘날 데이터는 새로운 경제재로서 기능을 갖기 시작했다. 그 이유는 데이터가 데이터 경제로 패러다임을 전환하고 있는 지능정보사회의 핵심요소이기 때문이다. 그러나 지능정보사회가 데이터 경제로 전환되는 과정에서 부닥치는 가장 큰 걸림돌은 데이터의 유통과 거래이다. 데이터는 생산 및 보유보다 유통과 거래를 통해서 그 가치가 극대화되는데, 현재로서는 데이터를 유통하고 거래할 수 있는 법적 기반이 마련되어 있지 않다. 현행 사법체계에는 데이터 이용을 규율하는 법률이 없으므로 데이터 이용은 배타적 권리의 인정을 통한 이용보다 계약을 통한 이용이 주로 이루어지고 있다. 그러나 데이터 이용은 아직 법적 기반이 불완전하고 불명확하므로 어떤 규율체계가 바람직한지 판단하기 어렵다. 그러므로 데이터의 자유로운 흐름과 관련하여 데이터개념을 어떻게 정의할 것인지 그리고 데이터에 대한 법적 보호를 어떻게 구성할 것 인지가 선결과제가 되고 있다. 이 연구는 데이터가 사법적 규율체계에 의하여 어떻게 보호될 수 있으며, 그 한계는 무엇인지 검토해 보기로 한다. 이를 위하여 데이터 개념, 종류 및 특성을 살펴보고, 데이터 이용을 위한 법적 논의들을 검토한 다음, 이를 토대로 데이터 이용에 대한 사법적 권리구제에 대하여 살펴보았다.

영문 초록

Today, data is starting to function as a new economic good. The reason is that data is a key element of the intelligent information society that is shifting the paradigm to the data economy. However, the biggest obstacle encountered in the transition of the intelligent information society to the data economy is the distribution and transaction of data. The value of data is maximized through distribution and transaction rather than production and holding, but there is currently no legal basis for data distribution and transaction. Since there is no law governing the use of data in the current judicial system, data use is mainly used through contracts rather than through recognition of exclusive rights. However, it is difficult to determine which discipline system is desirable because the legal basis for data use is still incomplete and unclear. Therefore, how to define the concept of data in relation to the free flow of data and how to organize legal protection for the data becomes the prerequisite. This study will examine how data can be protected by a judicial system and what are its limitations. To this end, the concept, types and characteristics of data are examined, legal discussions for data use are reviewed, and based on this, judicial remedy for data use will be examined.
