생명존중을 위한 낙태상담절차의 입법 필요성

국문 초록

2019년 4월 11일, 헌법재판소의 낙태죄 헌법불합치 판결로, 현행 낙태법은 2020년 12월까지 새로운 개정안을 입법해야 한다. 낙태가 태아의 생명을 앗아가고, 또 여성들의 몸과 마음에 심각한 상처를 남기는 매우 비극적인 선택이기 때문에, 주요선진국들의 낙태절차의 규정과 과정을 면밀히 검토하여, 생태와 생명존중, 인권가치를 지향하는 국가적 가치지향에 걸맞는 일관성 있는 낙태법 개정안이 도출되어야 할 것이다. 낙태법은 낙태를 손쉽게 허용하거나 방조하는 것이 아니라, 국민 생명을 보호하는 국가적 책무를 다할 수 있는 합리적 개정안이 되어야 할 것이다. 여성들이 준비되지 않은 임신, 위기의 상황에서도 더 나은 선택을 할 수 있도록 제도적인 보완장치를 반드시 마련해야 한다. 우리나라 낙태 선택의 대부분은 사회경제적 이유이다. 여성들이 진정으로 원하는 것은 낙태가 아니라 바로 사회경제적 지원이다. 그렇다면, 낙태법 개정안에는 여성들이 보다 나은 대안을 선택할 수 있는 사회경제적 제도 보완을 철저하고 충분하게 마련하고 이와 더불어 임신과 출산, 양육에 이르는 시기에 여성들에게 심리적 정서적 지원과 사회경제적 지원을 안내할 상담절차를 독일처럼 형법으로 규정하여, 국가의 국민생명 보호의 책무를 다하고 여성들에게 트라우마가 되는 낙태를 최대한 예방하는 입법을 도출해야 할 것이다. 더불어 다양한 증상을 동반하는 낙태로 인한 정신적 휴유증에 대한 치료와 상담에도 국가의 공적 지원을 제도화해야 할 것이다.

영문 초록

With the Constitutional Court s ruling against the Constitution on abortion on April 11, 2019, the current abortion law should legislate a new revision by December 2020. Because abortion is a very tragic choice that takes away fetuses lives and leaves serious scars on women s bodies and minds, the regulations and processes of abortion procedures in major developed countries should be carefully examined to produce a coherent abortion law revision that is consistent with national values oriented toward ecology valus, respect for life and human rights. The abortion law should not easily allow or aid abortion, but should be a reasonable amendment to fulfill the national responsibility for protecting people s lives. It is imperative to prepare institutional complementary measures so that women can make better choices in the face of unprepared pregnancies and crises. Most of the abortion options in our country are socioeconomic reasons. What women really want is not abortion, but socioeconomic support. Then, the abortion law revision should thoroughly and fully prepare for the supplementation of the socioeconomic system in which women can choose better alternatives and, in addition, enforce the criminal law to guide women with psychological and emotional support and socioeconomic support at times leading to pregnancy, childbirth and parenting, thereby fulfilling the nation s responsibility to protect national life and drawing up legislation to prevent abortions that are traumatic to women. In addition, the government should institutionalize public support for treatment and counseling on mental rest caused by abortions with various symptoms.
