공중보건적 접근에 의한 교정시설 내 정신질환 수용자 효율적 관리 방안

국문 초록

이 연구의 목적은 부산구치소 정신질환 노역수용자 사망 사건 이후 고조된 인권보호 중심의 정신질환수용자 관리 개선이라는 시대적 요구에 따라 현행 국내 형사사법 체계에서 고려할 수 있는 현실적대책을 제시하는 데 있다. 우선 정신질환자에 의한 범죄 발생과 형사사법 대응 체계를 살펴보고 문제점을 도출하였다. 정신질환 범죄인의 효율적 사법 관리를 위한 개선 방안으로 일반사회와 교정사회는동일해야 한다는 유사성의 원칙에 따라 공중보건적 접근을 모색하였다. 이에 선진 교정이라 할 수있는 영국의 정신질환 범죄인 관리제도 고찰을 통해 우리나라에 맞는 인권적인 정신질환 수용자의효율적 관리 개선방안을 제시하고자 하였다. 첫째, 정신질환 수용자들의 취약성을 관리할 수 있는공중보건적 관리체계를 구축해야 한다. 둘째, 일선 교정기관 내에 정신건강 전담 관리조직을 구성하고지방교정청 단위로 정신과 중심의 원격의료센터를 확대 설치해야 한다. 셋째, 중증 정신질환 수용자를위한 전담 수용동 운영 등 정신질환에 대한 의료서비스 제공을 신체질환과 동등한 수준으로 보장해야한다. 넷째, 정신건강의학과 진료의 대기시간 단축 및 진료 효율 향상을 위해 진료 의뢰 절차를 개선해야한다. 다섯째, 수용자에게 제공되는 정신의료서비스 수준의 향상 및 건강 형평성 제고를 위해 진료가이드라인을 설정해야 한다. 여섯째, 공중보건에서의 감염병 관리 개념에 의거한 향정신성 의약품오남용 확산방지 체계를 마련해야 한다. 일곱째, 구치소와 교도소 각각의 특성에 맞게 차별화된 정신건강 관리체계를 도입해야 한다. 여덟째, 범죄인의 정신건강 개선과 재범 감소라는 공동 목표 달성을위해 관계 부서·기관 간에 긴밀한 협력 체계를 구축해 나가야 한다.

영문 초록

This study is aimed to present practical measures that can be considered in the current criminal justice system in response to the historical demand for improvement of the management of mental illness inmates centered on human rights protection, which has been raised since the death of mental illness inmates at the Busan Detention Center. we investigated the crimes committed by mentally ill offenders and the criminal justice response system, and discovered the problems. As an improvement plan for the efficient judicial management of mentally ill offenders, we sought a public health approach based on the principle of similarity that the general and correctional societies should be the same. In response, we considered the British mental illness offenders management system, which can be called advanced correctional measures, and suggested efficient management and improvement measures for mental illness offenders in South Korea. First, a public health management system should be established to manage the vulnerabilities of psychiatric inmates. Second, the composition of a mental health management organization within each correctional institutions and the establishment of a psychiatric telemedicine center in each regional corrections headquarters should be expanded. Third, medical services for mental illness should be guaranteed at the same level as physical illness. Fourth, the government should improve measures to minimize the waiting period for psychiatric treatment. Fifth, medical guidelines for medical officers are needed to improve the level of mental health services provided to inmates. Sixth, the management of misuse and abuse of psychotropic substances should be based on the management of infectious diseases. Seventh, a differentiated mental health management system must be introduced to suit the characteristics of detention centres and prisons. Eighth, each correctional institutions should establish a close cooperative system between departments for the management of psychiatric inmates.
