국문 초록

플라톤의 「법률」은 교육을 그 핵심 관심사로 삼고 있으며, 거기서 전면에 부각되어 있는 법 또는 정치, 그리고 종교는 ‘덕’의 형성에 그 초점을 두고 있다. 우선, 법률은, 통념에서와는 달리, ‘강제’를 위한 법 조문 이외에 ‘설득’을 위한 ‘전문’(前文)을 함께 포함하는 독특한 형식을 띤다. 법률의 중심은 이 ‘전문’에 있으며, 그것은 법의 정신을 가르침으로써 법의 위반을 미연에 방지하는 데에 그 목적이 있다. 그리고 이러한 사고방식은 처벌을 ‘영혼의 치유’에 입각하여 규정하고 시행하는 것으로 이어진다. 다음으로, 종교는 법률의 원천을 이루고 있다. 신에 대한 불경죄를 방지하기 위하여 제시되는 ‘전문’은 일종의 ‘신학’으로서 다른 모든 ‘전문’의 근거가 되며, 따라서 다른 모든 법률의 근거가 된다. 이와 같이 보면, 종교는 법의 본래 의도인 교육에 근거를 부여하기도 하지만, 결국 그 의도의 최종적 실현을 나타내기도 한다. 「법률」의 국가는 ‘신정(神政) 국가’인 동시에 ‘교육 국가’인 것이다. 「국가론」과의 관련에서 보면, 「법률」의 국가는 ‘차선의 국가’이지만, 그 이상에 관한 한 그것은 「국가론」의 국가와 조금도 다르지 않다.

영문 초록

In his last and longest work, the Laws, Plato describes a state which has such distinctive features as the rule of law and the reverence for God. These features, however, cannot be properly understood without relating them to their underlying and unifying theme, that is, education. First, legislation in the Laws is primarily concerned with the education of citizens, and the ‘preambles’, which precede the ‘texts’ of laws, are meant to persuade the citizens to cherish the spirit of laws and not to violate the commands of laws. Through the ‘preambles’, legislation aims at inculcating the virtues in the souls of the citizens. And this is the very aim that lies at the heart of the art of politics. From this point of view, punishment is conceived of as a ‘cure’ of the soul. Second, the laws have their foundation in religion. In other words, God is the source of laws, as is evident from the ‘preamble’ to the law on impiety, or the so-called ‘theology’, which can be found in Book Ⅹ. This ‘theology’ provides a basis for all other ‘preambles’ and hence for all other laws. In this view, religion could be said to be both the foundation and the completion of education, because the original purpose of legislation lies in education which culminates in the belief in God. Thus, the state described in the Laws is a theocracy and simultaneously an educational state. There is no doubt that the state of the Laws is a second-best state as contrasted with the best state of the Republic. But it should not be overlooked that the former cannot be different from the latter as far as the ideal is concerned.
