앤드류 F. 사건의 미국 연방대법원 판결 사례를 통해 본 한국 특수교육 적절성에 대한 발전과제 고찰

국문 초록

미국 장애학생 앤드류 F.와 더글라스 지역교육청 사이에 있었던 교육비 보전 청구 소송은 학교가 학생에게 적절한 특수교육을 했는지에 대한 의심에서 출발하여 특수교육의 책무가 무엇인지를 재확인하게 해준 판례다. 장애학생에게 최소한의 진보만을 기대하는 수준을 넘어 모든 학생이 자신의 교육적 배치 상황에 맞게 의미 있는 교육적 혜택을 누릴 수 있도록 하는 특수교육의 적절성이 보장되어야 한다는 연방대법원의 판결이었다. 장애학생의 개별화교육계획(IEP)은 학생에게 도전 가능한 목표를 제시해야 하고 특별히 고안된 교수를 통해 학생이 적절한 진보를 할 수 있도록 실행되어야 함을 강조하였다. 이 판결은 한국의『장애인 등에 대한 특수교육법』과 비슷한 철학적, 법적 기조를 가진 미국『장애인교육법』에 기초한 것으로, 여기서 학생의 요구에 적절한 교육을 지향하는 우리나라의 특수교육에 적용해볼 수 있는 시사점과 함께 제도, 실행, 학술적 차원에서의 발전과제를 찾아볼 수 있다. 한국 특수교육의 적절성 제고를 위해 1) 교육 적절성의 의미 재확립, 2) IEP의 실체성 강화, 3) 증거 기반 실제의 현장 적용성 강화를 위한 디자인 기반 연구의 적용 가능성에 대해 논의하였다.

영문 초록

The purpose of this study was to analyze the U.S. Supreme Court’s decision on Endrew F. v. Douglas County School District (hereafter Endrew F. case, 2017), which established a high standard of what features an appropriate special education of students with disabilities. The decision, which was made under the Individual with Disabilities Education Act(IDEA) included schools’ obligation to provide IEPs with reasonably calculated annual goals and specially designed instructions to individual students in special education to achieve their goals. Also special education should enable each student to make a meaningful progress in the light of his/her circumstances. Such decisions changed the reference for the definition of appropriate education from some educational benefits to meaningful ones. Since IDEA and Korea’s Act on Special Education for Persons with Disabilities shared their theoretical and legal foundations, the judical decision of Endrew F. case would make some implications for enhancing the appropriateness of educational practices in Korean special education. Three major tasks for providing education appropriate to students with disabilities were suggested: 1) rebuilding the understanding of what constitutes appropriate education for students with disabilities; 2) restructuring how IEP works to meet their needs in more appropriate ways; and 3) increasing the feasibility of evidence-based practices in light of educational circumstances as well as using design-based research.
