평생교육조례를 통해서 본 개정 평생교육법의 실효성 분석

국문 초록

본 연구는 지방자치단체의 평생교육진흥 책무성과 관련하여 2007년 개정된 평생교육법의 법적 실효성을 밝히고자 하였다. 이를 위해 지방자치단체의 평생교육조례와 관련 추진 체제를 중심으로 평생교육의 조건 정비 동향을 분석하였다. 분석 결과, 법 개정 이후 많은 지자체가 평생교육 기반 조성과 사업을 활발히 추진해 나가고 있어 주민의 학습권 보장 측면에서 전반적인 변화가 이루어지고 있다고 평가할 수 있었다. 그렇지만 광역자치단체는 법 공포·시행 후 1년 이상 경과 후에야 조례를 제정한 곳들이 많았고, 기초자치단체는 기존 조례를 그대로 유지하거나 다른 이유로 인해 개정한 곳들도 많았다. 특히 광역자치단체는 평생교육진흥원 설치에 대한 미온적 태도로 독립기관의 설치보다는 유사기관에 지정을 계획하고 있는 곳들이 많아 전담 기관으로서의 실질적인 역할을 하기 어려울 것으로 예측되었다. 충남의 기초자치단체도 실제 평생학습관을 설치한 곳은 16개 시·군 중 3곳에 불과하였다. 그리고 여전히 조례를 제정하지 않은 지방자치단체가 있는 것으로 보아 법개정 이후 중앙 정부의 행정 부작위 문제가 여전히 남아 있다고 평가할 수 있다. 결론적으로 평생교육법이 개정되었음에도 불구하고 그 법적 실효성이 매우 취약함을 알 수 있었다.

영문 초록

This study analyzed the effectiveness of the revised lifelong education law focused on the building the promotion system of local lifelong education. We looked into the systems of all metropolitan level and local level of lifelong education systems in Chungnam province. According to the results, most of metropolitan authorities are establishing the foundation and the growth for the lifelong education initiatives was positive effect by Lifelong Education Act. One year later, a few local autonomous entities also do not accept the rule. Especially the metropolitan, they do not expect that it can do its quota to build the lifelong education development because it gives lukewarm responses. In reality, there are just 3 lifelong education development buildings in 16 different countries in the local autonomous entities. As a result, I found out that the law is not strong enough to spread through more than just 3 lifelong education development buildings. Still, there are some local autonomous entities which do not accept the law. In conclusion, We know that there are some problems throughout the acting process. We have to articulate the Law and regulation for the promoting the lifelong education initiatives and systems.
