외국인 근로자와 관련된 인권문제의 개선방안에 대한 연구

국문 초록

우리나라는 급속한 경제발전으로 소득수준이 높아지면서 1980년대 이후 국내 근로자들의 3D 업종에 대한 취업기피 현상으로 인해 업종에 따라서 심각한 인력난을 겪는 기업이 발생했다. 이에 따라 국내에서 저임금 외국인 근로자에 대한 수요가 증가했다. 그러나 외국인 근로자들에게 가해지고 있는 불법적인 인권침해 문제들로 인해 불법체류자가 크게 늘어나게 되었고, 이들에 대한 개선책에 대한 요구가 높아지고 있는 실정이다. 외국인 근로자들의 인권침해 문제는 어제 오늘의 일이 아니다. 그러나 이들에 대한 처우개선에 대한 문제는 근로의 문제이기에 앞서 인권의 문제임을 인식할 필요가 있다고 본다. 외국인 근로자가 위험을 감수하면서도 불법체류를 감행하는 이유로는 고용허가 대상 외국인 근로자에게 요구되는 과도한 소요비용, 사업장 변경 사유 및 근무처 변경 허가 기간, 사업장 변경횟수의 제한 문제, 노동 3권의 형식화 문제, 퇴직금 문제, 임금 및 산재 등에 대한 내국인과의 차별 문제 등이 지적되고 있으므로 이들 제도에 대한 개선이 요청된다. 현행법상 근로자란 직업의 종류와 관계없이 임금을 목적으로 사업이나 사업장에 근로를 제공하는 자를 말하는 것으로 외국인 근로자들 또한 근로자임에 틀림이 없으므로 외국인 근로자들의 인권보장과 올바른 근로환경 조성을 위하여 종합적이고, 장기적인 차원에서 제도개선과 이들의 근로보호를 위한 제도적인 장치의 마련이 필요하리라고 본다

영문 초록

Due to the sudden increase in income levels resulting from the rapid economic growth in South Korea, companies engaged in some business categories suffered labor shortage after the 1980s as local workers shied away from so-called 3D jobs. This led to a rise in the demand for low-paid foreign workers. However, illegal human rights abuses against foreign workers resulted in a surge in illegal aliens, and there are growing calls for improvement measures for them. The violation of foreign workers human rights is not something that emerged recently. However, it is necessary to recognize that improving their labor conditions is more of a human rights issue than a labor issue. Reasons highlighted as to why foreign workers take risk of illegal stay are: excessive expenses levied on employment-permitted foreign workers, reasons for change of workplace and permission period for workplace change, limitations on the number of changes in workplace, formalization of labor s three primary rights, severance pay issue, and discrimination against foreign workers regarding wages and workers compensation compared to local workers. Accordingly, improvement of regulations on them is needed. Under the current law, a worker refers to anyone who provides labor to a business or workplace to earn money regardless of the type of job, and, because immigrant workers are by all means workers, institutional measures for their protection and system improvement from a comprehensive and long-term perspective are thought to be necessary for foreign workers human rights guarantee and the creation of sound working environment.
