통합사례관리 법제화 및 사회복지전달체계 개편에 따른 사회복지법제 교육 방안

국문 초록

본 연구는 사회복지법제 교육의 중요성과 사회복지법제 교육방안 제시를 목적으로 한다. 따라서 연구의 목적을 수행하기 위한 방안으로 사회복지전달체계 및 통합사례관리법제화에 관한 사회복지법의 근거와 정책을 분석함으로써 사회복지전달체계 및 사례관리 관련 정책을 Gilbert & Terrell의 산물분석 방식으로 고찰하였다. 최근 사회복지전달체계 개편 양태는 읍면동 복지허브화 구축에 따른 통합사례관리 체계로 확대되고 있다. 통합사례관리의 법적 근거는 2017년 3월 21일 사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률 제42조의2 신설로 법제화 되어 복지사각지대 해소와 맞춤형 서비 스 제공에 주력하고 있다. 또한 통합사례관리를 수행하는 사회복지사의 전문성은 사회복지법률과 사회복지전달체계에 대한 통찰 수준에 따라 달리 평가될 수 있다. 따라서 사회복지전달체계 내 통합사례관리 확대로 촉구되는 서비스 연계 및 민관협력의 근거가 되는 사회복지법제의 이해와 사회복지법제 교육의 중요성이 제고되어야 하는 시점이다. 이에 궁극적으로 평생사회안전망에 관여하는 사회복지사의 전문적 역량을 강화할 수 있는 사회복지법제 교육의 기본적인 방향에 대하여 다음과 같이 제언하였다. 첫째, 사회복지전달체계 및 통합사례관리에 관련된 정책 및 실천적 근거가 사회보장기본법 및 개별 사회복지법률에 명시된 바와 같이 사회복지법제 교육은 학제간 융복합 교육 방식을 통한 “사회복지법 교육의 실용화”를 통하여 확대하고 교육 방식을 다양화 해야 한다. 둘째, 사회복지법제 교육은 사회복지에 관련된 인권과 구체적인 복지권 보장의 기본 방향으로 수행되어야 하며, 사회복지사의 제너럴리스트 역할과 스페셜리스트 역할 증진에 기여하는 사회복지 법제 교육의 성과에 대한 평가를 시도해야 한다. 셋째, 사회복지사의 양성과 전문성 증진을 위한 사회복지법제 교육은 사회복지법을 원활히 활용할 수 있도록 교육하는 “사회복지법 적용방법론”으로 고안하고, 사회복지법제론을 교육하기 위한 교수․학습 방식은 “사회복지법 교육방법론”으로 개발되어야 한다.

영문 초록

This study aims to highlight the importance of educating social welfare legislation and to present ways to educate social welfare legislation by analyzing the grounds and policies for social welfare legislation according to the integrated case management in the social welfare delivery system. Therefore, policies and theories were examined by Gilbert & Terrell s policy analysis method based on social welfare delivery system, case management theory and social welfare legislation. Recently, the social welfare delivery system has been expanded to an integrated case management system based on the establishment of welfare hubs in eup, myeon, and dong. On March 21, 2017, the legal basis for integrated case management was established with the enactment of Article 42-2 on the use and provision of social security benefits and identification of beneficiaries, thereby focusing on eliminating welfare blind spots and providing customized services. In addition, the level of expertise of social workers performing integrated case management can be evaluated differently depending on the level of insight into social welfare laws and social welfare delivery systems. Therefore, it is time to enhance understanding of service linkage, which is promoted by expanding integrated case management in social welfare delivery system, and of social welfare legislation, the base of public-private cooperation, and highlight the importance of educating social welfare legislation. Therefore, the basic direction of social welfare law education, which can ultimately strengthen the professional competence of social welfare workers involved in lifelong social safety nets, was suggested in the following way. First, as for the policies and practical grounds related to the social welfare delivery system and integrated case management, as stated in the social security basic law and the individual social welfare laws, the education of social welfare legislation education should be expanded through practical use of social welfare legislation education and diversification of educational methods. Second, the education of social welfare legislation should be carried out in the basic direction of guaranteeing human rights and concrete welfare rights related to social welfare, and its performance should be evaluated in terms of promoting the role of social welfare workers as generalists and specialists. Third, the education of social welfare legislation for training social welfare specialists and promoting their expertise should be designed as methodology of applying social welfare legislation to educate them to utilize social welfare legislation smoothly and the teaching and learning method for education of social welfare legislation should be developed into the methodology of educating social welfare legislation .
