장애인거주시설 무연고사망자 잔여재산 처리 방안 고찰

국문 초록

본 연구는 장애인거주시설을 이용하는 무연고 장애인의 사망시 잔여재산 처리방안을 고찰하고 구체적인 법률개정안을 제안하기 위한 목적으로 수행되었다. 이를 위하여 장애인거주시설에서의 무연고 장애인 잔여재산 처리 현황 등에 대한 면밀한 검토와 함께 민법 및 장애인복지법 등 관련 법률의 관계 규정을 심층적으로 분석하였으며, 장애인복지법 개정에 초점을 둔 네 가지 대안을 도출하였다. 기존 절차와 동일하게 처리하면서 세부 절차를 구체적으로 안내하는 방안(1안), 상속재산이 일정한 금액 이하인 경우 민법 외 별도의 간소한 절차로 처리하는 방안(2안), 민법 외 별도의 절차로 처리하는 방안(3안), 시설의 장이 시장․군수․구청장에게 보고하고 이후 업무는 시장․군수․구청장이 민법에 따라 처리하는 방안(4안) 중에서 앞선 1~3안의 경우 시설 종사자들로 하여금 이미 퇴소처리한 장애인에 관한 사무를 계속 처리하도록 함으로써 불필요한 사무 부담을 지우거나 잘못된 사무 처리 가능성을 높이고 간소화된 절차로 인하여 상속채권자 등의 권리를 침해하는 결과를 발생시킨다는 점에서 법률 개정의 실효성이 크지 않을 것으로 판단된다. 따라서 본 연구에서는 여러 행위 주체들의 기능과 역할에 따라 상속재산을 둘러싼 사무를 가장 적절히 배분하고 있고 절차를 거치면서 권리가 침해되는 자가 없다는 점에서 타 대안보다 비교 우위에 있으며 가장 실행가능성이 높은 4안을 최종안으로 제시하였다. 이를 통해 거주시설 내 무연고 장애인이 사망하였을 때 발생할 수 있는 거주시설의 고충을 해소하고, 특히 장애인거주시설 운영을 포함한 장애인복지서비스의 법률적 토대가 되는 ‘장애인복지법’의 법률적 흠결을 보완하는 데 기여할 수 있을 것으로 판단된다.

영문 초록

The purpose of this study is to examine alternatives dealing with the remaining assets of disabled persons and to propose a specific law amendment. To accomplish this end, we analyzed in detail the current state of dealing with the remaining assets of disabled persons in residential facilities for the disabled, and the relevant provisions of related laws such as the Civil Law and the Act on the Welfare for People with Disabilities. Also four alternatives focused on the revision of the Act on the Welfare for People with Disabilities were derived and respective alternatives are as follows. The first alternative is to guide the detailed procedure in the same way as the existing procedure and the second alternative is to handle by way of the simplified procedure other than the civil law if the remaining assets are below a certain amount. Then the third alternative is to treat by way of separate procedure other than the Civil Law and the fourth alternative is to have the director of the facility report to the mayor, the head of the municipal administration and then the mayor of the municipality deal with the remaining assets in accordance with the Civil Law. The previous three alternatives are assumed to be not more effective in that these will cause unnecessary administrative burdens, increase the possibility of improper handling, and result in infringement of the rights of inheritance creditors. Therefore, in this study, the fourth alternative is comparatively superior to other alternatives in that it divides the affairs of inherited property most appropriately according to the functions and roles of the actors and does not infringe the rights of inheritance creditors. Ultimately, the fourth alternative is expected to contribute to overcome the difficulties of residential facilities when a irrelative disabled person dies in a residential facility and to supplement the legal defects of the Act on the Welfare for People with Disabilities, which is the legal basis of disabled people s welfare services including operation of residential facilities for the disabled.
