학교폭력 학생부 기재 정책의 합리성에 대한 비판적 고찰

국문 초록

이 연구에서는 학교폭력에 대한 이론적 논의를 바탕으로 학교폭력 학생부 기재 정책의 타 당성을 비판적으로 분석하고자 하였다. 학생부 기재의 학교폭력 억제 효과 주장은, ‘잠재적 폭력학생’이 합리적인 손익(입시?취업 상의 불이익)계산을 할 줄 알고, 합리적으로 선택하 며, 자신의 이익을 위해 자신의 감정과 행동을 통제할 줄 안다는 것을 전제한 것으로 그 전 제에 대한 의문이 제기된다. 또한, 학생 개인의 합리적 선택의 논리는 학교폭력이 집단의 영 향을 받지 않는 학생 개개인의 의사결정에 따른 선택이라는 가정에 입각한 것으로 이러한 가정 또한 타당한 것인지 의문이 제기된다. 그리고 학생부 기재 효과를 고려함에 있어 학교 폭력전력이 있는 학생의 성장 과정에 어떠한 부정적 영향을 지속해서 미칠 것인지 검토가 필요하다. 이에 따라 이 연구에서는 학생부 기재 정책이 학교폭력을 억제할 수 있는 적절하 고 효과적인 정책인지, 피해학생의 인권을 보호하고 상처를 치유할 수 있는 정책인지, 또한 학교폭력 기재 학생에 대한 처벌의 극대화가 적절한 것인지, 어떤 사회적 부작용을 일으킬 지를 분석하였다. 이 연구결과를 바탕으로, 학생부 기재 정책이 폐지되는 것이 합리적이며 타당하다는 결론을 제시하고, 학교폭력의 억제 효과를 기대할 수 있는 정책적 대안이 무엇 인지를 모색하였다. 그 대안으로 합리적 손익계산의 공리주의적 관점보다는 ‘상호주관적 인 정관계의 훼손’이라는 규범적 관점에서 접근하는 것이 학교폭력 문제해결에 필요함이 제시 되었다.

영문 초록

In this study, my purpose is to critically analyze the anti-bullying policy putting school violence on the school life record of bullies. This policy is intended to bring about the deterrent effect by giving serious disadvantages to the bullies in the process of the college admission and employment in the future. The results of this study are followings. There is little probability that the school violence could be strongly controlled, human right of the victims could be protected, and the damage of the victims and community could be restored by the anti-bullying policy. In these respects, the anti-bullying policy is not effective and adequate as the means of controlling the school violence. Additionally, the stigma accompanied by school life record of the bullies is not just double penalty but also a violence in that it damages the identity of the individual and his/her self-realization in the society. There is the probability that the anti-bullying policy promotes the secondary crime of the bullies and thereby brings about the serious social cost. In conclusion, it is very reasonable to abolish the anti-bully policy putting school violence on the school life record of bullies. In other words, we should abolish the anti-bully policy intended to give serious disadvantages to the bullies on the basis of their school life record in the process of the college admission and employment in the future. In order to solve the problem of the school violence, it is suggested that we need to switch our perspective on the school violence from the utilitarian view of calculations of benefit and loss to the normative view of intersubjective relations of recognition for inviolability of physical integrity, dignity as persons, and worth of ability and way of life.
