국문 초록

Traditional legal theory often seems too rigid when it comes to applying and interpreting laws, which highlights its limitations. The Free Law Movement and the Sociological School of Law have criticized this rigidity and introduced sociological methods of interpretation. This article, based on the practical needs of judicial activities, aims to analyze the scope and impact of sociological interpretation methods in the judicial process. Through case studies and comparative research, it reveals the potential and challenges of applying sociological interpretation in civil cases, especially in specific contexts like fairness considerations in civil trials, showing its multidimensional support for case decisions. On this basis, it suggests measures such as standardizing judicial interpretation methods and cultivating judicial talents with diverse perspectives to improve the application mechanism of sociological interpretation methods, thereby ensuring judicial fairness while fully leveraging the role of sociological interpretation.

영문 초록

传统的概念法学在适用和解释法律时显得过于机械化，这暴露出了其不足之处。自由法学派和法社会学派对概念法学的机械化特征提出了批判，并引入了社会学的解释方法。本文从司法活动的实际需求出发，旨在分析社会学解释方法在司法过程中的适用范围及其影响。通过案例分析和比较研究，揭示了社会学解释方法在民事案件中应用的潜力和挑战，尤其是在民事审判的公平考量等具体情境中，展现出其对案件决策的多维支持。在此基础上，提出了通过规范司法解释方法、培养多元化视角的司法人才等措施来完善社会学解释方法的应用机制，从而在保证司法公正的前提下，更加充分地发挥社会学解释的作用。
