국문 초록

With the development of the electronic age, the number of artificial intelligence generated products is increasing. The emergence of Sora, as a representative of Wensheng videos, has pushed artificial intelligence to a new climax. However, whether the content generated by Wensheng videos belongs to works under copyright law has also sparked widespread controversy. This article takes cultural videos as the exploration object, analyzes the originality and subjective and objective elements of the copyrightability of cultural videos through the current protection dilemma of cultural videos, and finally compares and analyzes the three different protection paths of copyright generation, adjacency rights, and newly established rights in cultural videos. It proposes useful legal ideas for the construction and protection of new rights in artificial intelligence cultural videos.

영문 초록

随着电子时代的发展人工智能生成物日益增多，以sora 为代表的文生视频的出现更是将人工智能推向了新的高潮，但文生视频所生成内容是否属于版权法中的作品也引发了广泛争议。本文以文生视频为探讨对象，通过目前文生视频的保护困境，分析文生视频可版权性的独创性与创作者等主客观要件，最后对比分析文生视频生成版权、邻接权与新设权利三种不同的保护路径，对人工智能文生视频新设权利构建及其保护提出有益的法学思路。
