국문 초록

이 연구는 2024년 5월 17일자로 발효된 ｢국가유산기본법｣의 시행 맥락과 발전 과제를 분석하였다. ｢국가 유산기본법｣의 시행 배경은 크게 세 가지로 확인된다. 첫째, 문화재를 보는 관점과 기준의 변화를 반영하였다. 둘 째, 국제 기준인 유네스코 유산 분류 체계와 우리나라의 문화재 분류 체계의 부합을 도모하였다. 셋째, 헤리티지 에 대한 국가의 보호책임을 강조하였다. 현시점에서 우선 필요한 작업은, 유네스코가 국제 기준이 될 수 없다는 일부의 반론을 차치하고라도, 당초 취지대로 과연 우리나라 ｢국가유산기본법｣이 유네스코의 헤리티지 개념과 세계유산 체계와 부합하는지 점검하는 일이다. 연구 결과, 다음과 같은 발전 과제를 도출할 수 있었다. 첫째, 헤리 티지의 최상위 범주를 문화유산과 자연유산의 두 가지로 바로 잡아야 한다. 둘째, 무형유산을 문화유산의 하위 범 주로 재편성하고 용어는 무형문화유산으로 수정해야 한다. 셋째, 자연환경과의 상호작용으로 탄생한 유산은 자 연유산이 아닌 문화유산으로 재설정해야 한다. 넷째, 주요 발전 과제들을 진단하고 논하기 위한 이론가 자문 그룹 을 국가유산청 직속으로 운영할 필요가 있다.

영문 초록

This study analyzes the context and development tasks of the ｢Framework Act on National Heritage ｣, which came into effect on May 17, 2024. The context of the ｢Framework Act on National Heritage｣ can be broadly identified in three ways: Reflecting major changes in perspectives and standards for viewing cultural properties; Matching of the national heritage classification system with the UNESCO heritage classification system which is an international standard; Emphasis on the state’s responsibility to protect its heritage. However, in order to make use of the original purpose, it was analyzed that the following development tasks must be resolved: First, the division of the main categories of heritage must be corrected; Second, intangible heritage should be reestablished as a subcategory of cultural heritage and the terminology should be revised to intangible cultural heritage; Third, heritages created through interaction with the natural environment should be re-recognized as cultural heritage rather than natural heritage; Fourth, in order to solve major development tasks, it is necessary to operate a group of theorists directly under the National Heritage Administration.
