국문 초록

생성 AI의 개발, 운용ㆍ유지 및 지원ㆍ컨설팅 등에 관한 주요 논점으로는 AI 윤리에 관한 논점, 생성 AI로 제공할 수 있는 내용에 관한 논점, 학습 및 생성물의 이용으로 인한 타인의 권리 침해에 관한 논점, 생성 AI에 대한 공격의 대응에 관한 논점, 각국의 규제에 관한 논점 등이 있다. 수임인은 위임의 본뜻에 따라 선량한 관리자의 주의로써 위임사무를 처리할 의무를 지는데(민법 제681조), 이러한 ‘선량한 관리자의 주의’는 일반적ㆍ객관적 주의의 기준에 지나지 않으므로, 구체적인 사례에서 급부 채무의 특성에 따라 구체적 기준이 설정되어야 한다. 이러한 생성 AI에 관한 업무에서의 선관주의의무의 주요 내용은 업무를 적법하게 유지할 것, 업무를 위임인의 목적에 합치시킬 것, 위임인의 불이익을 회피할 것 등이다. 생성 AI의 위임계약은 학습용 데이터의 수집과 수집한 데이터를 AI 모델의 작성에 적용하기 위한 가공ㆍ처리 등에 대한 업무에 관한 개발위임계약, 생성 AI를 개발하여 타인에게 제공하는 위임인이 수임인에게 운용ㆍ감시 등을 위임하는 업무 등에 관한 운용ㆍ유지위임계약, 위임인의 생성 AI에 관한 관리 체제 정비에 대한 지원 업무 등에 관한 지원 ㆍ컨설팅계약 등이 있다. 특히 지원ㆍ컨설팅계약에 대해서는 담당자에 따른 선관주의의무, 업무의 유형에 따른 선관주의의무, 업무의 효율화와 관련된 선관주의의무 등으로 나눌 수 있다.

영문 초록

Major issues regarding generative AI include issues regarding AI ethics, issues regarding what can be provided with generative AI, issues regarding the infringement of the rights of others due to learning and the use of products, issues regarding the response of attacks on generative AI, and issues regarding regulations in each country. The mandate is obligated to handle the delegation work with the care of a good manager according to the original intent of the delegation (Article 681 of the Civil Act), and since this “good manager's attention” is only a standard of general and objective attention, specific standards should be set according to the characteristics of the performance obligation in specific cases. The main contents of the necessity of care in the work of such generative AI are to keep the work legal, to fit the work with the purpose of the delegator, and to avoid disadvantages of the delegator. Delegation contracts for the use of generative AI include development delegation contracts for processing and processing tasks to collect and apply the collected data to the creation of AI models, operation and maintenance delegation contracts for the task of delegating the operation and monitoring of the delegation to the delegation, and support and consultation contracts for supporting the maintenance of the management system for generative AI. In particular, support and consulting contracts can be divided into the duty of care of a good manager according to the person in charge, the duty of care of a good manager according to the type of work, and the duty of care of a good manager related to the efficiency of work.
