일본 형사정책의 주요 동향과 실무 현안

국문 초록

일본 형사정책 동향이 최근 많은 변화 양상을 보여 주목할 필요가 있다. 그간 특유의 보수적이고 신중한 태도로 형사입법에 소극적이었다고 평가할 수 있으나, 재범방지 목적을 위한 2022년 6월 13일 구금형 창설 등을 비롯하여 과거와 달리 최근에는 형사입법을 적극적으로 추진하고 있다. 특히 부동의성교등죄, 아동 그루밍 성범죄, 불법촬영죄 등의 신설로 나타난 ‘성범죄 엄벌화’는 우리의 디지털 등 ‘성범죄 엄벌화’ 형사정책과 유사한 상황이라고 볼 수 있다. 이외에도 반대신문 조건부로 성범죄 피해자 등의 진술 영상녹화물의 증거능력을 인정하는 특칙을 신설하였으며, 모욕죄의 법정형을 상향하는 개정 등이 있었다. 한편으로 형사정책은 각국의 사회현상과 법 제도의 차이로 인해 유사한 부분도 있고 다른 부분도 나타나게 된다. 특히 구금형 창설이나 집행유예제도 개정 등은 재범방지대책으로서 일본의 법 제도적 상황이 많이 반영된 형사정책이라 할 수 있다. 이처럼 우리나라 형사법과 관련성이 깊은 일본 형사정책을 살펴보는 것은 지금도 마찬가지고 앞으로도 우리 형사정책의 현재를 객관적으로 평가를 할 수 있는 기준점을 제공한다는 점에서 연구대상으로서 의미가 크다.

영문 초록

Japan's criminal policy trends have recently undergone a number of changes that are worthy of attention. While it can be said that Japan has been passive in criminal legislation due to its conservative and cautious attitude, it has recently been actively promoting criminal legislation unlike in the past, including the ‘enactment of imprisonment’ on June 13, 2022 for the purpose of preventing recidivism. In particular, the ‘punitivism of sex crimes’ manifested in the new crimes of immovable sexual intercourse and immovable groping can be seen as a similar situation to our criminal policy of ‘punitivism of sex crimes’ including digital. In addition, a special rule was established to recognize the admissibility of video recordings of statements by victims of sexual crimes under the condition of cross-examination, and amendments were made to increase the statutory sentence for insulting crimes. On the one hand, criminal policies have similarities and differences due to differences in social phenomena and legal systems in each country. In particular, the ‘enactment of imprisonment’ and the revision of the probation system are criminal policies that reflect the Japanese legal system as a recidivism prevention policy. Therefore, examining Japanese criminal policy, which is highly relevant to Korean criminal law, has great significance as a research object because it provides a reference point for objectively evaluating the current state of Korean criminal policy.
