강구진 교수의 생애와 형사법사상

국문 초록

강구진 교수는 “수석합격, 수석졸업, 졸업식 때 대통령상을 수상하는 행운까지 겸비한 법대의 실력 참피언”으로 소개되었던 천재적 두뇌의 소유자로서 5년여의 판사생활 후 법원을 떠나 학계로 온 주목받던 젊은 형사법학자였다. 그 당시에는 법관이교수로 온 것은 매우 드문 사례로서, 강 교수의 학문에 대한 열정을 능히 짐작할 수있다. 강 교수가 대학에 부임한지 10년도 되지 아니한 시기에 별세하셔서 그를 지도교수로 하여 석사학위를 취득한 제자들이 많지 않았으며, 그의 지도로 박사학위를 받은사람은 아무도 없는 것으로 알고 있다. 강 교수는 대학 교수로 임용되고 8년이 되는 해인 1984년 4월 42세의 젊은 나이에교통사고로 돌아가셨지만, 천재성에 특유의 근면함까지 발휘하여 형법과 형사소송법, 형사정책은 물론 법ㆍ법학교육에 이르기까지 수많은 논문을 발표하였고, 형사소송법원론 을 비롯하여 중요한 저서도 다수 출간하였다. 그가 형법강의 각론Ⅰ (박영사, 1983)에 연이어 출간할 계획이었던 형법강의 총론 과 형법강의 각론Ⅱ 가 그의뜻대로 출간되었다면 우리 형사법학계를 자극하고 더욱 풍부하게 하는 등 뚜렷한 족적을 남겼을 것이다. 특히 강 교수는 남북분단 상황에서 자료의 부족 내지 빈곤이라는 치명적인 어려움에도 불구하고 누구도 감히 생각하지 못한 북한법의 연구에 남다른 의욕을 가졌던선구자이다. 그가 북한법의 연구 서문에서 “본서는 필자의 북한법 연구의 시작에 불과하다. 앞으로도 계속하여 본서의 속편 간행에 주력할까 한다.”라고 한 각오는 갑작스런 별세로 인하여 좌절되었지만 그의 연구를 토대로 향후에는 많은 연구가 이어져야 하고 또 그렇게 될 것으로 믿는다. 강구진 교수는 개인주의ㆍ자유주의에 기반한 형법과 당사자주의적 형사소송구조를지향한 형사법학자이고, 북한의 법과 형사사법제도를 분석하여 그 문제점을 예리하게지적한 북한법 전문학자라고 평가할 수 있을 것이다. 그가 형사법을 포함하여 법학의발전을 위해 제시하였던 사상과 정책들은 앞을 내다 본 탁견으로서 여전히 유효하고우리에게 시사하는 바가 많다고 생각한다.

영문 초록

Professor Koo-Chin Kang as a genius who was introduced as “a talented champion of law school who had the good fortune to take top place on the entrance exam, graduate summa cum laude, and win the President’s Award at the graduation ceremony” was a young criminal law scholar who left the court after five years as a judge and came to academia. At that time, it was very rare for a judge to come as a professor, which is a testament to Professor Kang’s enthusiasm for studying and learning. Prof. Kang passed away less than 10 years after he was appointed to the Department of Law, Seoul National University, so not many of his students obtained a master’s degree with him as their adviser, and I know that none of them received a doctorate under his guidance. Professor Kang died in a car accident at the young age of 42 in April 1984, eight years after his appointment as a professor, but he displayed his genius and characteristic diligence, and published numerous papers on criminal law, criminal procedure, criminal policy, and law and legal education, as well as a number of important books, including Korean Criminal Procedure A Textbook . If the General Lectures on Criminal Law and Lectures on Criminal Law Ⅱ , which he planned to publish in succession to Lectures on Criminal Law I (Pakyoungsa, 1983), had been published according to his wishes, he would have left a distinct mark by stimulating and enriching the Korean criminal law academia. In particular, Professor Kang is a pioneer who had an extraordinary desire to study North Korean law, which no one dared to think about, despite the fatal difficulties of lack of data and bibliography in the situation of the division of the North and the South. In the preface to A Study on North Korean Law he says, “This book is only the beginning of my research on North Korean law. I will continue to focus on publishing a sequel to this book.” He passed away suddenly in an accident, thus unable to fulfill his intention of publishing a sequel to that book. I believe that many studies should follow in his research and will indeed come to fruition that way. Professor Koo-Chin Kang can be regarded as a criminal law scholar who pursued criminal law based on individualism and liberalism and argued party-oriented criminal procedure(adversary system), and a scholar specializing in North Korean law who analyzed North Korea’s laws and criminal justice system and pointed out its problems. I think that the ideas and policies that he presented for the development of jurisprudence, including criminal law, are still valid and have many implications for us as a far-sighted perspective.
