국문 초록

형벌의 절차법 영역과 보안처분에서 형벌불소급원칙이 적용되어야 하는지의 논의는 죄형법정원칙과 관련된 중요한 문제인만큼, 이미 많은 선행연구들이 이를 검토한바 있다. 하지만 그 내용을 보면 주로 형벌불소급원칙 적용유무에만 초점이 맞추어져있고, 형벌불소급원칙이 적용되지 않을 경우, 후속적으로 검토해야 하는 부분에 대해서는 자세한 설명이 생략되어 있다. 이에 본 글에서는 논의의 다양성 및 논증 강화를위해 다음의 3가지 지점에 대해 검토하였다. 첫째, 법률불소급원칙, 형벌불소급원칙, 신뢰보호원칙의 관계 둘째, 형벌과 보안처분 영역에서 소급효가 문제되는 구체적 지점 셋째, 진정소급입법인지 부진정소급입법인지를 판단하는 논증 과정

영문 초록

Whether the principle of criminal non-retroactivity applies to the procedural law on criminal penalties and security measures has long been an important topic in criminal law. However, current discussions on this issue are focused mainly on whether criminal sanctions fall within the scope of application of the principle of criminal non-retroactivity, with little attention given to the specific effects of applying the principle. Accordingly, to deepen the level of discussion, this paper reviews the following three points: (i) the concepts and scope of application of the principle of non-retroactivity of law, the principle of criminal non-retroactivity, and the principle of trust protection, and the similarities and differences in determining their application; (ii) specific aspects in criminal penalties and security measures for which retroactivity is an issue and the process of examination thereof; and (iii) the process of determining whether the specific form of retroactive legislation is genuine retroactive legislation or non-genuine retroactive legislation
