국문 초록

보험은 예측 불가능한 위협을 경험할 수 있는 현대인의 안전한 삶을 영위하게 해주는 수단이다. 그러나 보험을 이용한 교묘한 범죄수법은 기업화, 국제화, 조직화 되어가며 나날이 발전하는 중이다. 이를 방지하기 위해 2016년「보험사기 방지 특별법」이 제정 및 시행되었지만, 보험범죄는 오히려 그 적발인원과 피해금액에서 증가추세를 보이고 있는 실정이다. 선행연구들에서 보고되었듯이 보험범죄에 의한 피해는 개인에게는 물론이거니와 국민 경제에도 영향을 미친다. 이렇듯 날로 커지는 보험범죄에 대한 방지대책은 여러 형사사법기관에서도 주목하고 있지만, 일반 민영기관에서도 특수한 조직을 꾸려 보험범죄를 방지하기 위해 노력하고 있다. 그 중 보험범죄특별조사팀(SIU: Special Investigation Unit)은 보험사에 구성되어 있고 최일선에서 보험범죄를 예방, 대응하는 기관이다. 그 중요성에도 불구하고 국내에서는 SIU의 현황과 문제점을 중심으로 심도있게 다룬 연구들은 전무하다. 따라서 이 연구는 문헌 고찰을 통해 보험범죄의 의의와 보험범죄실를 분석하고, 현재 증가하는 보험범죄에 대한 효율적 조사를 위해 우리나라 민영보험기관의 조사팀인 보험범죄특별조사팀(SIU)을 중심으로 보험범죄에 대한 대응체계를 설명하는 것에 목적이 있다. 이러한 결과를 바탕으로 보험범죄의 효율적 대응체계 구축을 위한 제언을 하였다.

영문 초록

“Insurance” is a mean of enabling modern people to lead a safe life that can experience unpredictable threats. However, sophisticated criminal methods using insurance are developing as they become corporate, internationalized, and organized. To prevent this, the Special Act on the Prevention of Insurance Frauds was enacted and implemented in 2016, but insurance crimes are on the rise in the number of people caught and the amount of damage. As reported in previous studies, the damage caused by insurance crimes affects the national economy as well as individuals. Various criminal justice agencies are paying attention to such growing measures to prevent insurance crimes, but general private institutions are also working to prevent insurance crimes by setting up special organizations. Among them, the Special Investigation Unit (SIU) is composed of insurance companies and is an institution that prevents and responds to insurance crimes at the forefront. Despite its importance, there are no studies in Korea that have dealt with the current status and problems of SIU in depth. Therefore, this study aims to analyze the significance of insurance crimes and the insurance crime room through literature review, and to explain the response system to insurance crimes, focusing on the SIU, an investigation team of private insurance companies in Korea, to efficiently investigate the current increase in insurance crimes. Based on these results, suggestions were made to establish an effective response system for insurance crimes.
