프랑스 음악실연자 권리의 변천 과정과 시사점

국문 초록

본 연구는 최근 프랑스 음악산업에 관련되는 일련의 법 제도적 혁신 속에서 특히 프랑스 음악실연자의 법적 권리가 어떻게 변화하였고 이것이 주는 시사점이 무엇인지를고찰하였다. 프랑스 실연자들은 1950년대 두 단체를 결성해서 지금까지 자신의 권리를보호하고 강화하기 위해 음반제작자를 상대로 협상을 진행해 왔다. 프랑스에서는 1985 년에 저작인접권이 인정되면서 실연자의 법적 지위가 마련되었다. 2019년 유럽연합 저작권 지침이 통과되면서 2021년 프랑스 자국법에 이 지침을 반영하는 법률명령이 제정되었다. 이 명령을 기초로 프랑스의 음악실연자는 스트리밍에서 발생하는 전송권 사용료 분배에서 전례 없는 최소 보상을 약속받았다. 또 이용자로부터 투명한 정보공개를 요구할 수 있는 권리와 양도 후 추가 보상을 요청할 수 있는 권리도 보장받았다. 이 연구의시사점은 다음과 같다. 프랑스 실연자들은 집단 연대를 통해 오늘날까지 자신들의 권리를 강화해 왔다. 이것이 유럽연합 지침이나 프랑스 저작권법에서 실연권의 진일보한 개정이 나온 배경이다. 프랑스 음악실연자 단체의 수입 중에 절대적으로 중요한 것은 보상금이다. 상대적으로 권리가 열악한 실연자에게 보상청구권이 나름 실질적으로 이바지하고 있는 셈이다. 디지털 기술이 고도화되는 오늘날 전송권은 가장 중요한 배타적 권리가되었다. 음악실연자의 전송권 사용료 요율은 오랫동안 가장 낮은 수준에 머물고 있다. 2022년에 타결된 프랑스의 협약서는 음악실연자의 스트리밍 사용료의 불공정성을 획기적으로 개선하였다.

영문 초록

This study examined how the legal rights of French music performers have changed, especially in the recent series of legal and institutional innovations related to the French music industry, and what their implications are. French performers formed two groups in the 1950s and have been negotiating with record producers to protect and strengthen their rights. In France, the legal status of performers was established when neighboring rights were recognized in 1985. With the passage of the EU Copyright Directive in 2019, a legal order was enacted to reflect this directive in French domestic law in 2021. Based on this order, music performers in France were promised unprecedented minimum remuneration from streaming. It was also guaranteed the right to request transparent information disclosure from users and the right to request additional remuneration after transfer. The implications of this study are as follows. French performers have strengthened their rights to this day through collective solidarity. This is the background of improved amendments to performance rights in the European Union guidelines or French copyright law. The remuneration is an absolutely important part of the income of French music performers. In other words, the right to claim remuneration is making a substantial contribution to performers with relatively weak rights. In a highly digital society, the right to transmission has become the most important exclusive right. The fee rate for music performers’ transmission rights has long remained at the lowest level. The French agreement reached in 2022 dramatically improved the unfairness of streaming fees for music performers.
