선장에 대한 특별사법경찰권 부여 제도 폐지 및 그 대안에 관한 연구

국문 초록

특별사법경찰제도는 일반사법경찰의 전문성의 보충과 범죄지 등의 장소적 격리성 을 극복하기 위함이 목적이다. 대다수 국가는 전문 행정기관 소속의 공무원만을 특별 사법경찰관으로 두고 있으나 우리나라는 일부 영역에 관하여 사인으로 하여금 특별사 법경찰 업무를 수행하도록 한다. 해선상에서 발생하는 모든 범죄에 대하여 사인인 선장에게 특별사법경찰권을 부여 하는 것은 장소적 격리성을 극복하기 위하여 전문성을 유보한 것으로 이해한다. 그러나 실무 현실은 선장 등의 인식 및 준비 부족으로 인한 사법경찰권 발동 불능 및 수사권 행사시 예상되는 부작용의 심각성, 특별사법경찰권을 행사한 사례 자체가 전무한 점 등으로 선장 등에 대한 특별사법경찰권 부여 제도는 유명무실한 제도가 되 었다. 현대의 교통과 통신의 획기적 발달로 더 이상 장소적 격리성의 극복이라는 이유 로 하는 이 제도는 그 존재 의의를 상실하였고 제도의 실익이 현저히 적다. 법이론적인 면이나 현실적 효용성의 측면에서나 특별한 취지와 의미를 찾을 수 없게 된 선장 등에 대한 특별사법경찰권 부여 제도는 폐지하는 것이 바람직할 것이다. 동 제도의 폐지 가능성과 그에 대한 형사 사법적 대안을 제시한다.

영문 초록

The purpose of the special judicial police system is to supplement th e expertise of the general judicial police and to overcome the geographi cal isolation of the crime scene. Most countries have only public officia ls belonging to specialized administrative agencies as special judicial pol ice officers, but in Korea, private persons perform special judicial polic e duties in some areas. Giving special judicial police powers to the captain, who is a private pe rson, for all crimes that occur on a maritime ship is to reserve experti se in order to overcome spatial isolation. However, in practice, the system for granting special judicial police po wers to captains, etc. is ineffective due to the inability to invoke judici al police powers due to lack of awareness and preparation by captains, etc., the seriousness of expected side effects when exercising investigative powers, and the fact that there are no cases in which special judic ial police powers have been exercised. became a system. Due to the ep och-making development of modern transportation and communication, t his system, which was no longer meant to overcome spatial isolation, l ost its significance. It is desirable to abolish the system of granting special judicial police p owers to captains who have no special meaning in terms of legal theor y or practical utility. The possibility of abolition of the system and cri minal justice alternatives are presented.
