재건축부담금 산정 방식의 개선을 위한 합리적 방안에 관한 연구

국문 초록

본 연구의 목적은 재건축정비사업에 있어 재건축부담금이 얼마나 과도한지, 이러한 과도한 부담금이 산정되는 원인이 무엇인지 살펴보고, 그 해결 방안을 연구하는데 있다. 재건축부담금 제도의 모태가 된 개발부담금 제도의 개발부담금과 재건축부담금은 그 목적과 성격, 산정방법 등이 매우 유사하나 실질 부담의 차이가 과도하여 형평과 균형에 문제의 우려가 있다. 이에 본 연구에서는 문헌분석과 최근 재건축부담금 부과가 예정된 서울 및 경기도 소재 재건축사업구역의 사례분석을 통해 불합리한 부담금의 내용을 살펴보고, 그 해결 방안을 다양한 측면에서 제안하였다. 재건축부담금은 서초·강남권, 비강남권 등 지역적 요인이나 단지규모, 아파트가격수준 등에 상관없이 대체로 높게 산정되어 부담되고 있으며, 부담금의 산정기준이 되는 초과이익 산정방법의 개선과 부과율등 기타 개선방법을 통하여 합리적으로 개선할 필요가 있다. 재건축부담금의 합리적인 산정을 위해 개시 및 종료시점 주택가격의 산정기준 및 시세반영률 등을 일치시키고, 전문 기관을 통해 산정함으로써 객관성과 공정성을 확보하는 방안을 제시하였다. 유사 법제도간의 균형, 형평성을 도모하고, 신축아파트 공급 부족으로 심각한 부작용에 시달리고 있는 현 부동산 시장에, 제도개선을 통해 부동산 가격안 정과 국민경제의 건전한 발전, 사회통합의 목적달성을 이루기를 기대해 본다.

영문 초록

The purpose of this study is to examine how excessive the reconstruction levy is in the reconstruction maintenance project, what the cause of such excessive charge is calculated, and to study the solution. The development levy and reconstruction levy of the development levy system, which became the basis of the reconstruction levy system, are very similar in purpose, nature, and calculation method, but the difference in actual burden is excessive, raising concerns about equity and balance. In this regard, this study examines the contents of unreasonable charges through literature analysis and case analysis of reconstruction project areas in Seoul and Gyeonggi-do, where reconstruction charges are scheduled to be imposed recently, and proposes solutions from various aspects. The reconstruction levy is generally high regardless of regional factors, such as Seocho, Gangnam, and non-Gangnam areas, complex size, and apartment price level. It needs to be rationally improved. In order to reasonably calculate the reconstruction levy, various measures were proposed to ensure objectivity and fairness by matching the calculation standards and market price reflection rate of the housing price at the start and end of the reconstruction, and by calculating through a specialized institution. In the current real estate market, which is suffering from serious side effects due to the lack of supply of newly built apartments, we hope to achieve the goals of stabilizing real estate prices, sound development of the national economy, and social integration through institutional improvements.
