국문 초록

본 연구는 유치권이 부동산경매의 매각가율에 어떠한 영향을 미치는지를 헤도닉가격모형 형태의 두가지 모형을사용하여 실증분석 한다. 기존 선행연구의 대부분은 진위여부가 확인되지 않은 유치권 경매정보를 활용하였지만, 본 연구는 법원 종합법률정보 홈페이지의 판례를 전수조사하여 진정성 있는 유치권 분쟁 경매사건을 확보하여 실증분석을 수행한다. 이를 통해 선행연구 결과를 재확인한다. 경매정보의 유치권행사 여부와 판례로 확보한 유치권 진위여부를 대용변수로 활용하여 유치권 제도의 운영이 초래하는 정보비대칭성 문제를 확인한다. 그 결과로, 유치권의 진위여부 불일치 비중, 매각가율의 차이를 확인한다. 정보비대칭으로 초래된 역선택은 유치권 제도 운영의 개선필요성을 제시한다

영문 초록

This study empirically analyzes how mechanical liens affect the auction sales price ratio by comparing two competing hedonic pricing models. While most existing studies use unverified mechanical lien information as an independent variable, this study uses verified lien information as an independent variable by searching all court cases on the court’s comprehensive legal information website. The empirical analysis confirms the results of previous studies. By comparing the mechanical lien status in the auction information and the verified mechanical lien status confirmed by the court judgment as independent variables, we identify the information asymmetry problem caused by the current mechanical lien system. As a result, we find differences in the proportion of the true lien status and the auction sales price ratio. The adverse selection caused by information asymmetry suggests the need to improve the operation of the mechanical lien system.
