국문 초록

과학기술의 발전은 형사사법 분야에 다양한 영향을 미친다. 우선, 첨단기술을 이용한 법익침해에 대응할 형벌 규정의 미비가 확인되면, 범죄구성요건을 신설 또는 정비해야 할 필요성이 대두된다. 또한 처벌 규정이 존재함에도 불구하고 종래의 수사 및 재판 방식으로 범죄에 대응하는 데에 한계가 있는 경우에는 새로운 제도의 도입이 모색되기도 한다. 뿐만 아니라 과학기술은 수사나 재판의 효율성을 제고하기 위해서도 활용되는데, 그 논의 과정에서는 종종 기본권 침해 문제가 불거지기도 한다. 이에 본 논문은 과학기술의 발전에 따른 형사절차의 변화와 이와 관련된 헌법적 쟁점에 대해 논하였다. 먼저, 과학기술의 발전이 형사절차에 미친 영향들을 조망하는 한편, 암호화･익명화 기술이나 자율주행기술과 같은 첨단기술이 상용화됨에 따라서 형사절차상 어떤 변화가 요구되고 있는지를 검토하였다. 아울러 인공지능과 드론, 로봇기술, 사물인터넷, 확장현실 등의 첨단기술을 형사절차상 활용하는 과정에서 제기되는 헌법적 쟁점에 대해서도 살펴보았다.

영문 초록

The development of science and technology has a wide range of impacts on the criminal procedure. First, once it is acknowledged that there is a lack of penalty regulations to the violation of legal right and interest using advanced technologies, a need to establish newly or improve the existing elements of a crime arises. Also, where there are penalty regulations but the existing investigation and trial method have a limitation in properly responding to the crimes of such kind, an attempt to adopt a new policy is sought on occasions. In addition, while science and technology are used to improve the efficiency of investigation or trial sometimes, the problem of the violation of basic human rights is often noticed in the course of discussion. With this background in mind, this paper examined the changes in the criminal procedure due to the development of science and technology and the constitutional issues related thereto. First, this paper looked into the impacts of science and technology on the criminal procedure, and then investigated the types of changes that are required in the criminal procedures with the commercialization of the advanced technologies, such as encryption and data anonymizationas well as autonomous driving technology. Furthermore, it explored the constitutional issues raised in the course of adopting advanced technologies such as artificial intelligence(AI), drone, robotics, internet of things(IoT), and extended realities(XR) in the criminal procedure.
