국문 초록

현대 사회의 첨단과학기술의 발전으로 인해 테러공격의 수단과 방법 역시 은밀하고 과학적으로 변해가고 있으며, 이를 전 세계는 초국가적 안보위협으로 인식하고 공동으로 대응하고 있는 실정이다. 테러리즘에 대한 예방적 차원에서의 대테러 정보활동은 국가마다 처해 있는 안보환경과 국내 실정법에 따라 다양하게 나타나고 있다. 국내의 경우에는 테러방지법상의 대테러 정보활동이 규정되어 있지만, 국민의 기본권 제한 측면을 고려하여 정보⋅수사기관의 책무가 사실상 한계점을 드러내고 있다. 주요 안보선진국가에서는 테러와 같은 안보사범에 대응하기 위한 절차적 예외 법규들을 규정하고 있으며, 일반적인 형사범죄와는 다르게 취급하고 있다. 국내의 대테러 정보활동의 경우에는 테러위험인물에 대한 정보수집, 테러 선전과 선동에 대한 긴급삭제 요청권, 외국인 테러전투원 규제 등 다양한 대테러 정보활동을 실시하고 있으며, 대테러조사권으로 이들에 대한 행정조사활동을 실시하고 있다.

영문 초록

The means and methods of terrorist attacks are also becoming secretive and scientific due to the development of advanced science and technology in modern society. The world recognizes it as a transnational security threat and is responding to it jointly. Counter- terrorism intelligence activities in the preventive dimension against terrorism appear in various ways according to the national security environment and domestic law. In the case of Korea, anti-terrorism intelligence activities are stipulated under the Anti-Terrorism Act, but in consideration of the restriction of the people's constitutional rights, the responsibilities of intelligence and investigation agencies are actually limiting. Major security-advanced countries regulate procedural exceptions to respond to security crimes such as terrorism, and treat them differently from general criminal crimes. In the case of domestic counter- terrorism intelligence activities, various counter-terrorism intelligence activities are conducted, such as information collection on terrorist risk persons, the right to request emergency deletion of terrorism propaganda and incitement, and regulation of foreign terrorist fighters, and administrative investigation activities against them with the right to investigate terrorism. is being carried out.
