독일의 통신비밀제한법상 통신제한조치에 대한 검토

국문 초록

정보통신기술의 발전은 일상생활의 이익을 주는 과학적인 도구로써 이용되기도 하지만, 타인의 사적인 영역을 불법적으로 침해하는 일종의 범죄행위로써 이용되기도 한다. 특히 개인의 통신비밀의 자유는 지극히 사적인 영역에 해당하며, 불특정 다수에 대한 기본권 침해행위는 피해자 없는 범죄행위로써 추상적이며 상당한 위험성을 내포하고 있기 때문에 통신비밀의 자유를 제대로 보호하기 위한 통신제한조치에 대해 진지하게 논의해야만 한다. 이와 관련하여 독일에서의 통신제한조치는 암호통신감청, 온라인 수색 등 다양한 방법으로 시행되고 있으며, 일반적인 사항과 예외적인 사항으로 구분하여 요건과 절차를 규정하고 있다. 국내에서도 통신비밀보호법에서 통신제한조치에 있어서 일반적인 통신제한조치와 국가안보 또는 긴급통신제한조치에 대한 요건과 절차를 규정하고 있지만, 수단과 방법에 대해서는 구체적인 유형에 대해 논의할 필요가 있다.

영문 초록

The development of information and communication technology is used as a scientific tool to benefit daily life. However, it is also used as a criminal act to illegally invade the privacy of others. In particular, the freedom of communication secrecy is an extremely private domain, and the act of violating basic rights against an unspecified number of people poses abstract risks as a victimless criminal act. Therefore, it is necessary to seriously discuss measures to restrict communication to properly protect the freedom of communication secrecy. In this regard, communication-restricting measures in Germany are implemented in various ways, such as encrypted communication interception and online search, and requirements and procedures are stipulated by dividing general and exceptional matters. Even in Korea, the Protection of Communications Secrets Act stipulates the requirements and procedures for general communication- restricting measures and national security or emergency communication- restricting measures, but it is necessary to discuss specific types of means and methods.
